Why did you choose to return to US on AP instead of H1? I am currently done with my 6 years of H1, but have an approved 3 year extension. The visa stamp in my passport has expired. I am planning to go to mexico on vacation for 10 days. My lawyer told me that I could go and return on H1 since it is within 30 days. Automatic visa revalidation. She said that the IO at the counter should give me a new I-94 with the 3 years out date stamped on it.
We had applied for PR in Canada and were asked to do the final landing process in Canada by end of December'07. So we chose the thanksgiving weekend to land in Toronto.
--Going out of US----
I did an eChecking, went straight to security, the security officer took a look at our Canadian visa and without fuss let us go. We were worried that nobody kept our old I-94, so we asked the flight hostess. She said that since we were returning within 30 days (3 day trip), we didn't need to surrender our I-94, otherwise she would have taken it at the time of boarding.
The landing process went smooth. We first went to customs officer. We had taken an inventory list of our household items. On the customs form, you have to mark the you have goods to follow. He was OK with everything else.
Then we went to the immigration officer- he was surprised that we live in US and asked us that we should move to Canada and avail of the PR there as it is "not nice" to take the PR in Canada and not live there. I told him that I will check out the job prospects there. Then we went to another customs area, where we showed the inventory (2 copies)and they just stamped the list and gave one copy to us. I had also taken cashiers checks to show proof of funds.
--Coming back to US ---
Coming back, the US immigration officers are present in Toronto itself. Which is nice in the sense that when you land in the US, you just walk out of the airport.
We were sure of which line to stand in - visa holders vs. GC. We stood in visa holders line. The immigration officer seemed to be aware of Adv Parole and EAD and asked us to go to secondary inspection.
We went in another room for secondary inspection. The officer told us that they have new rules in place for Adv Parole and they have to verify all the records etc. It took about 20 minutes and he gave us a new I-94 to our surprise. We asked him if he wants our older I-94s back and he said "oh yes". So we gave the older I-94s to him. Now the I-94 that we have says we are Adjusting Status - so I am guessing H1 petition is no longer valid.
The whole process took about 45 minutes including wait time. 15 minutes for security. But we almost missed out flight.
So guys if you have EAD and AP, be at the airport 1.5 hrs earlier to boarding time!

The above is clearly mentioned on CIS website, above processing times updates, puts an end to all my hopes. My application reached to CIS in early JULY 2007, but I got receipt issued in last week of Sept 2007.
The speed at which CIS is moving, I may get my 485 processed only after another year or so. I have been following 'processing date updates' religiously for past year or so, and there no hope. CIS wants to achieve goal of 5 months naturalisation time, and my 485 app is still not processed after 22 months of filling. WHaT a JoKE?:mad::mad::mad::mad::mad::mad:

On The alien # inconsistency, I have a question
In some of my documnets, EAD ,AOS receipt notice etc my A# is 'A091XXXXXX'
In my AP etc it does not have a zero. i,e 'A91XXXXXX'.
Is this OK or will it cause problems.

So i had an appointment with my lawyer yesterday and here is the result:
-motion to reopen will not not work quickly as i dont have the denial notice (maybe they never sent one), and waiting for the letter or a response to my request can last years.
-re-filing i485 from the beginning will cause problems again with my 2 different alien numbers and the same problems will repeat themselves.
-attorney inquiry: trying to see the adjustment supervisor in NYC and have him/her fix the problems in my case: the Alien numbers, not receiving interview or denial notices, their computer system fiasco, may again delay everything and it will be a waste of time.
-Writ of Mandamus, in other words suing USCIS will make them review my case and fix the problems and give me an interview date, will be the best and time efficient move. They dont want to lose another case and they will ask to settle before even going to the court. At least that's what happened to my lawyer with her other clients.
I think that nothing can't go worse than now, so i will sue them! i cant lose anything here. or can i? has anyone had a bad experience with this?

US employment based immigation system, unlike that of other countries such as Canada and Australia, is based on market demand. If recession hits, there will be a lot of layoffs, especially in the financial sectors. A lot of outsourcing will happen to cut costs, which will increase the demand in work force in India and China. We can expect a lot of people to return home. This will free up visa numbers and the result will be - faster GC.
But, at that time, getting GC will not be any sweeter than returning home.
People...please contradict/support/offer alternate opinions.

By the way running a company is lot more complex than you dream,......IRS/DOL/State agencies/Insurance/USCIS thats just the beginning and thats a lot of risk as well....
I agree, "Ability to Pay" issue is one good example when it comes to processing GC.
It might sound funny, but this is what I think.
How about registering the company as a non-profit organization and start collecting funds for the victims affected by blood sucking employers? Once you have enough money to cover the operating expenses, you can start hiring people and pay 100%. You can continue fund rising to run your business, your employee would be a better source to start with. :)

Are you guys sure that you can make deductions for home loan interest paid for homes outside the US? AFAIK, thats not allowed. For home loan interest paid in the US, you get a form from your mortgage lender/bank. You don't get any such form recognized by IRS for interest paid in India or else where.
Why would US want to give you deductions for your investments/home some where else? I will be really amazed to find out that the US allows deductions for interest paid on home loans outside of US.

It would be worse for these people to wait additional 5 years to get their citizenship. I believe it would make sense to reduce the waiting time for these people by counting 5 years from their priority date or something of that sort. Would it make sense to work with senators and congressmen to have some kind of ruling on this front to ease this pain?
Please let us know your opinion.

Rather than trying to jump ships, try to find projects and heed the advice of your employer on the best way to find it. He/she too has an interest in finding you a project. However, you can help yourself by looking for project on your own and then referring the client to your employer.

But for consulting jobs, Dice.com would have most positions. BE OPEN to various skills that may be required at different projects and be prepared to learn them quickly.

I have filed a complaint to DOL against my employer who did not pay me for more than thee months.
I am on H1B.
My employer asked me to vacate the guest house, i am staying in a motel now.
Actually i left the guest house on his mails but did not board the flight which he booked for me as i was not paid for last three and half months.
But i am getting mails from my employer that i need to go back to india since he does not have work for me.
Can he report to DOL and USCIS that i have been absconded for last 3-4 days and make my record dirty with USCIS he can say that i mysteriously left the guest house and not reporting to him.
Is there anyway i can report to USCIS about my condition that i am not absconded but trying to fight against my employer and need a weeks time to settle other things before i go back.
OR should i go back as my employer officially saying to go back but did not address my salary issue.
Please advise

Or you have only posted on IV forums and hope that Joel and Time Magazine will come and read your post and apologize?
Not a single person till now has written to Time and posted a response. This shows that Indians deserve what they got from Joel and worse. They are more interested in Indian parties, Bollywood stage shows and making lots of green dollars. Where are Indian organizations protesting. Remember two years ago a radio talk show host made a small comment on the blacks in the college basket ball team. It became a national news and black leaders were all over on TV asking him to be fired. This talk show had a difficult time saving his career.
