My company's lawyers are not responding to my emails because of the AOS backlog at their place. I do have a valid H1 that I can use to re enter US.
Any recommendations for a lawyer who has experience and can help in this case?

Practically the I-140 PP does'nt help everybody. But it helps people like me who are now zeroing in on 6'th Year.
Only with this kind of thing, i can get 3 years extension , otherwise with 1-140 being stuck, i can get only 1 year extensions which is bizarre.
They practically thought every possible scenario and selected few to help them
The guys who are whining, they will leave their employers once -140 is cleared since they might have got 485 in the last year open gate.
There are lot of things in you and your family that might need to pay attention to get things done right way.
Dont point Fingers at USCIS. They are hearing us. They have to go by whats defined to them as regulations.
We have lot of things to do on our side too before whining at someone.

My case is NSC-CSC-NSC. i-485 applied in NSC in July 07, transferred to CSC for data entry, transferred back to NSC in 2007. Welcome email received today.

Hi All,
I have a query, Maybe some of the experts here can help me out.
My H1 visa has expired but I have a valid I-797A with my H-1 petition, applied by my employer at the time of extension.
I am travelling to India from Newark, New York via FrankFurt on Lufthansa.
Do I need to have a transit visa ?

One suggestion...if you flying from Chicago.... Take the direct flight to Delhi ... and if you are flying from NY , take the direct flight to Mumbai...you will save 5-6 hours and use the visa money for flight to destination within India if you don't belong to Delhi or Mumabi....
Kick the transit visa.... just fly free of mind...

I am surprised why so far we have not knocked on White House doors, we need to urgently bring to President Bush's attention, even though his immigration bill suffered recently, in our case he can certainly use a presidential veto.
Can someone draft a letter, we can sign. It would be great if we could hold a rally at DC without loosing time!

I have heard of a thing called MEETING where people gather to discuss an agenda.
I strongly think that someone should be monitoring the threads opened with headlines like "MEATING " and yesterday someone wanted a HOME WARM up. Gives a really bad impression of a community that is skilled .

I think that is a very good idea. If my EB3 Labor approves, that is exactly what I am going to do also.. Remember once your I140 approves, your Priority date is locked.. so, even if you file for your labor at a later date, your PD remains 2003, so, I'd say donot think twice and proceed with EB2 filing... atleast there is a chance thate EB2 may move at least 1 yr in the next few months.. so, you could file for your 485 as well... my 2 cents..

I think we will have an update once reliable information is available. At this point we only have some media stuff to go by. IV will come up with an update once information is directly received from Congressional offices and/or through our lobbyists. This is clearly not an easy environment. We are fighting both pro and anti immigrants for various reasons. Hold on tight- the ride is getting rockier! :)

Well, contact the congressman. You can't really predict on that.
I called USCIS almost everyday and one evening I was talking to level 2 folks and explained about the case and informed them that I have sent the details to Congreeman. Somehow they have transferrred it to the next level where they have confirmed all the details. As I was represented by an attorney, IO wanted to talk to the attorney and I could not get hold of the attorney as it was late in the evening but attorney called them the following day.

Yes they are concerned. But I'm sure they don't advocate the extremist measures proposed by fringe nuts like Tancredo. The state of his presidential campaign attests to that. Indiana is a red state in case you didn't know. Gun lobby and Religion are the biggest things there.
Actually the manufacturing states should complain as lot of manufacturing jobs are being taken up by illegals through employment agencies and also the auto manufacturers and meat processing plants have moved to Mexico, Central America or Canada.

A question about the State Chapter joining. Of late we are seeing less and less info on the website. Are we now moving to an "offline" model?
the state chapters are being strengthened for sure, remember we are ultimately a grassroots organization. also, in the current environment, everything cannot be posted publicly. so we would really like to see everyone involved at the local level too. i'm not saying the forum is not important or is being ignored...quite the contrary, but the grassroots effort has to be paramount if we are to succeed.

On the encashed checks USCIS would have stamped your I-140 receipt number. If you can get access to a copy of the check you can easily pull out the number. Also, your new attorney will have to send a new attorney representation form otherwise any RFE or even approval notice will go to your old attorney and you will have bigger problems retrieving information at that stage.

Employer & I signed the transfer form and the new Lawyer requested for all the I140 related documents from previous legal. The previous legal has not provided the I140 receipt notice or any status so far.
Now, the new legal is suggesting that the only option we have is to apply for new I140 and request to transfer the previous I140. Not to mention, this lawyer is expensive and I have to pay the fees. It�s strange that they can request for transfer of I140, but cannot ask for the receipt number from USCIS.

I am from Bangladesh, EB3, PD May 2006. I applied mine and my wife's i-485 in July 2007. They requested for some REF IN 2009 January after I changed my job. I am working using my EAD now. My EAD is expiring in September 2010. I applied for the extension in mid June and expecting the approval in beginning of September 2010.
Today I found something very interesting on m y online status. I found out that my I485 status update date changed to today's date. But there is not update in the I765 status date.
Does anyone experienced this before? What could be the probable reason for this date update.
i am very much anxious about the whole situation. Is there anything to worry about?

hey Guys,
I live in Canton, MI (suburb of Detroit, MI) I am on H1b visa and I have valid I-94 expiring September 2011 and planning to travel to Canada over the weekend to catch up with friends...i have few questions, i would really appreciate if you guys can help..
1. Is it safe to travel to canada on h1b visa? are there any issues that i could run into at the port of entry while coming back? i have been hearing really bad stories (it could be just stories) from all around, about people on h1b being denied entry to US at Port of entry while coming back from home country and all that sort. Am i going to run into any such issues if i'm just going for the weekend (leaving friday evening, returning sunday evening).
2. Lot of guys on this thread are suggesting not to hand over I-94 to visa officer while entering Canada, my I-94 for is stapled into my passport. Will visa officer at port of entry to Canada take this out? and will i be issued new I-94 with same expiry date (Sept 2011 as it shows on current one) when i enter back to US?
3. I am planning to travel with my wife and she is in H-4, again will there be any issues at Port of entry while coming back to US for her if she is traveling with me?
Please advise guys.
