It seems February Bulletin took over all the attention. Pretty sad that I-485 can not be filed.
Hope to extend H1B by 3 years, secure an employment and transfer H1.
I will be happy if these things happen. These will fetch me some more time in USA.

What will eliminate any element of lingering doubt is if someone can come up with some kind of concept like "Consulting Employees Union". Not to be confused with labor union etc.....but more in the spirit of how Federal Credit Unions differ from Banks... Credit unions are owned by the members themselves...and they are not for the profit of owners/shareholders etc like in the case of a bank....All the profits are passed along to members.
Similarly What if one comes up with a concept of a "Employee Owned Consulting Company" EOCC :D
There might be lot of legalities involved like can a employee working on EAD or H1 or whatever for such a company can be a 'owner' (in part..however small that part may be) of that company....and still not violate any USCIS rules/regulations etc...
Sure there may be costs to run such a company...which may come from a variable (exactly what was spent), or flat fee/percentage deducted from employee pay. It could be 5% or less or more. And people wouldn't have any issue with that...As long as its not owned by a single/group of founding fathers who may eventually fall prey to the lure of dollars !

I don't think the new fee regulation says anywhere that 'renewals' of EAD and AP would be FREE. It's just for the first time that they come free with I-485. next time you renew, they won't ask you if you paid the old fee or the new fee in the beginning. you'll have to pay the new renewal fee every time.
Note True.. EAD & AP renewal will have no fee if you file I1485 under new fee structure
just Google for USCIS fee increase and you will find the official documents.

Boy, that's tough. I don't see grounds for filing a new I-140, since you'd have the same problem. In addition, your PERM is now out of date - the I-140 needs to be filed within 6 months of PERM approval.

My PERM is still pending as of now as it was filed in first week of Feb'2010, once I get PERM approval I'll make sure that we file 140 within the timeframe.

I am planning to travel to Canada and get back within couple of days. I had my H1 extended while I was in US and therefore don't have the H1 stamp in my passport. I had read somewhere that if you travel to adjacent countries (Canada and Mexico) and get back within 30 days then you will be allowed in to US without the H1 stamp in the passport as long as you have the H1 approval (I-797) letter.
Is this true? Experts please help.

4) Have a valid passport.
5) Not from one of the 7 countries currently listed as sponsors of terrorism.
And please make sure that you do not surrender your I-94 when leaving the US

I got 221(g) when I try for visa stamping. I already have AP. I'm planning to re-enter US by using AP and still wanted to maintain my H1-B status. Recently got married and my wife is planning to attend for H4 visa stamping in couple of months. Since I already got 221(g) and entered US using AP, does it causes any issues for my H4 stamping?

I read somewhere in this forum itself that a laid off H1B worker is entitled to many benefits, and most workers are not even aware of it.
Somebody mentioned in these forums that a laid off h1 employee was successfully able to negotiate with his company to buy is apartment lease, car, household goods for a reasonable prices. The company did not actually buy these items, but gave him the equivalent compensation.
Ask your friend to contact some attorney. They will be able to help him out.
I agree to the fact that more than 4 years back i had read somewhere online that the employer should give a fair value for the employee possession and even give him a ticked back home. I don't really recollect was it when the employer was filling LCA for the H1B applicant for green card.
I was working on H1B visa with my former employer(1 weeks. back). I got laid off and the employer handed me unemployment insurance. I told him i don't know whether i will be eligible for that. I think you need to buy my car, lease everything and send me home. The HR agreed that the company has to give me a return ticket to go home. I asked them for 2 weeks notice and he paid me with severenace pay. Basically I have a EAD which my employer did not know and i applied for unemployment benifits.
Asking is okay. Take it if you can get but as per the present law the employer has to give one way ticket just to the employee. That's the rule. I searched everywhere to find it but did not find this last week.

You need to show that the delay is unreasonable. If RD is not outside of processing dates, how can you do that? USCIS will simply reply that it's working on your case.
