Yep, Ron is good attorney and person. However, it is very difficult for anyone to predict DOS or USCIS. Ron has been correct and wrong as much as anyone else.
Looking at the movement of the dates, it seriously doubt that they are doing quarterly spillover; at least not yet.
The only 100% way to find out is if we can get any direct info from DOS/USCIS or wait till the end of fiscal year (if we see a big jump again in last quarter, that will mean spillover is happening only yearly).

How will this affect the GC process ?....let us say one claims his/her parents as dependents and get a RFE to produce Tax Returns. Immigration officer sees parents were claimed as dependents. Now how will this be interpreted ? Favorable/Unfavorable ????

IF i get my EAD and AP and six months have past then i know I can use AC21 portability to change jobs but do i have to be continously employed or can I take time off/extended vacation and go to india for 6 months and come back and try to find a new job...
There is fine line involved.
First you need to get onto EAD from H1. Secondly after the 180 day rule,
you need not look for a job immediately. When the INS requests for info. u need to atleast provide them a job offer.
The applicant can take advantage of AC21's portability provisions and obtain approval of the Adjustment of Status application, provided the case has been unadjudicated for 180 days or more. As indicated by INS processing times, it is a very rare case that is adjudicated within 180 days. The applicant does need to obtain a new job that is the same or similar to that described in the labor certification. However, the adjustment applicant does not need to obtain the new position immediately. The AOS applicant must be able to show the INS that he has a qualifying new job offer when that the INS requests this information, either in a Request for Evidence or at an in-person interview. Therefore, the applicant has ample time in most cases to secure new employment.

it was such a dumb rebuttal to amy chua's rather confused piece to begin with. there are so many forces macro & micro working together that its very difficult to manage it from either a 'family' or 'employment' perspective. bigot mark pretends to take offense at why decent people are shocked by his xenophobic rantings and call him out on it. time & again, whether it be speed laws or drug laws which are observed more in the breach, bigot marks incoherent response is that highways are built only for such speeds or something even dumber. in a time when legal employment-based immigration is choked and people are living in suspended animation forever, partly why illegal immigration has surged so much, bigot mark's brilliant idea is to reduce legal immigration across the board! and when 54% of the country is ok with even amnesty bigot mark has to cheap shot amnesty advocates as 'elite'!mark , if you still wonder why people hurl such 'epithets' at you, you are not just a bigot - you are stupid & dumb as well. get your head examined - maybe it will lead to a chemical-cure for bigotry!

If USCIS had enough resources to send 2 officers to every H1B holder and spend 2 hours, they would have cleared all backlogs!

I have an approved H1-B petition. But I am currently on my L1-B and haven't yet converted to H1. I intended to continue with my L1 untill I get something good.
However today morning I got a surprise visit from USCIS. There were 2 officers and they had questioned me for about 2 hours. I must admit, I goofed up a bit as I wasn't prepared.
....
All your advice is highly appreciated.

The letter must also state the salary that will be paid.

My understanding is that the letter will be from the 2nd employer in case of a job switch based on the I-140 approval.
Please clarify.

Even my lawyer screwed my case. Did eb3 instead of eb2. I have got I-140 approved.
Mine too :mad: :mad: :mad: Its simply appalling that so many of lawyers screw up so many cases and still get paid $$$. There must be something we could do about these stupid, money gouging so called lawyers.
