USCIS wanted to prove how my education is equivalent to a US BS degree. I hold a Masters in Computer Application from a good Indian university. My companies’ law office responded to the RFE on time and provided all the course syllabus, certificates and EVALUATION report.
My I140 was approved. It was a premium processing at Nebraska.

I doubt that many people will support this thought. So far the CP interview scheduled at US consulates in India does not even cross 100. I doubt that DOS was worried for these 100 people and that's why they set the EB2 India date to 1 June 2006. Its almost proved that unless USCIS act fast, majority of 20K visas that we have estimated ... will go waste.
It could also be that the estimate of 20K is plainly incorrect.
By moving date to 06/01, if DOS could clear all pending applications at CP, I don't see that as a bad move as that also gives USCIS, the flexibility to approve applications randomly.
Are you saying that USCIS has cleared all pending applications until 2004 and reason why DOS has moved the dates to 2006? And if that was true, then come October dates should stay at 2006 if not go back to 2003 or so. Let us wait and watch.

My guess is EB2 & EB3 will be U for rest of the year.
EB2 and EB3 are the same. I would recommend EB3-I to port to EB2-I when the EB2 dates moves ahead. So basically, there won't be any good news for EB2 for a long time.

If you both are using EAD, you can not bring your child on H4.
on the side not (sorry if it is personal), I did not understand why your wife is going to india for delivery ? Don't you have insurance ? Doctors generally advise not to travel long journey ? She will get better treatment here.. and you can call somebody from your family to be here too...

I had got an RFE for education. My employer applied labor under EB2. I did my B.E back in India and had 7 years of experience. My lawyer sent new evaluation report and I140 was approved in month.

Count me in. We should post this thread or message to to recent GC holders who got their approvals in Sept/Oct and November..(including myself). So, EB2- I,C (2004) IV needs you. Come back :)
People who got recent approvals would be still subscribed to Sept/Oct master approval thread so our chances of reaching them would be higher. I , in fact, (re) proposed couple of weeks ago a new advocacy effort for reducing citizenship wait time..and there was strong interest among community members as wells as list of good ideas on how to go about it.

My Case:I have 10 months remaining in 7th year and I am planning to switch company. He( the attorney) wants to buy time to file my PERM. Since remaining 10 months was not sufficient for him to file GC, therefore he needed the 8th year.
It is my understanding that filing PERM is nothing to do with how much time you have left on your H1B and these are two seprate items...
Question:
1. Can the new employer file for H1B transfer for remaining 10months on my 7th year and 8th year. Initially the attorney of the new employer told me that the transfer is not possible. Did anyone get the same advice.
2. Finally he is going to try 7th & 8th year. Have anyone file for remaining 7th year & 8th year. Pls let me know.
Correct.Bottom line is any H1B extn can only be filed 6 months before not more than that.Two options.First option is you could file for transfer for 10 months and then once it is approved then before 6 months of expiry file for 8th year extn.Second option is wait for 4 more months and do the H1B transfer ,at that time you are elible for H1B 8th year extn.If I were you I will go for the second option provided current situation permits.

if it passes then there will be lot of people in the queue behind us.
And never expect a fiasco like July 2007, if you are expecting that.
USCIS is more cautious now, the PD movement will be 2 years in 3 months in that pace.
And do not mix Illegal with EB-category, there will be a seperate department crated for
illegal immigrants, and they already included in the summary, that Illegals should be
ready to wait for long years to get citizenship.
And all this is If "CIR PASSES" Only. there is only 5 % of chance passing it.
if it is not passing, our re-capture will be passes as amendment and then that is about it
so dont be worried unnecessarily.

I have done some research into this category.
500k option seems easy but it has also some string attached.
Few basics of EB5
(1) Fund needs to be legal. If you bring from India then there should be enough trace of funds. Lets say some one gift you money in India then you need to show that you paid gift taxes in India. If you get gift from some one here then you need to pay close to 75k as gift tax in USA.
(2) I searched for few regional center program and almost all program charges 30-50k administrative fees ( Application Fee ) which is non refundable if GC denied.
(3) If you borrow money against your property in USA or India and invest into this program still you may not be able to balance it. Average Loan rate will be 10- 12 % while average return in Eb5 regional program is 6 - 10 %.
(4) You cannot withdraw money for 3-4 years. Some program ask you to make commitment of 5 years. Also no one specify exit strategy.
(5) Some program hold your money into Escrow account meanwhile you get your GC and once they collect enough amount to kick start project they will not give you any damn return. ( Just interest rate which is very very low these days ) so lets say you invest money today and they cannot collect enough money for next 1 year then you need to wait for 1 year to have them invest and another 1-2 year for them to start giving out return. and besides that once return starts there will be a commitment for certain years.
bottom line is if you have spare of 600k-650k money and not expecting more than 0-5 % return on that money you can go for EB5 for shake of GC. if you have 1.1 - 1.2 million then
you can buy business and employ 10 full time USC. That can give you more return.

I also did the same thing. Do not worry, they will correct it when you go to give finger printing. Or you can call the NSC and update them. I immediately called nsc and updated them. But then i think its pointless, since they will anyway correct all the information at the biometrics. Good luck.

It can also be none of the above if restrictionists have their way.
There is a possibility of tightening the EB greencard process and H1bs. Do not be surprised if that happens because there is an effort in that direction. The bad economy is helping such attempts. It would be tough to go in this direction because the industry will oppose that.
What you can see is border enforcement, path to citizenship for undocumented and dream act included in it. This is because we are hearing that CHC is putting lot of pressure for an immigration reform.

I respect your opinion, But things have already changed, people have less faith on companies, specially after the downfall of the financial sector. A point system will come out as a fair system, where companies will have less control on filling a green card for the potential employees. Look at Australia or Canada their immigration system is more favorable why? Because of the point system.
Isn't that the notion Obama has been beating all this while? And if he had used a point system in the past, their is a strong chance he will use it again.
So what happened to US system? A lot of companies, DESI companies exploited the system, senator Dubin and all are not against immigration, but they want to stop a bad practice of H1b system. Isnt' that going to help all of us?

So it looks like two H1B can exist "live" at one time. If I work full time with company B, then the lawyer must amed the 1st H1B for lower pay.
So what is the lowest company A can pay me (I think it is the prevailing wage hourly rate or annual rate). If my position has lowest prevailing wage, ex: $30 per hour, then what is the best option so that he can pay me the least ( even no pay is good, as long as my H1 status is preserved with them as I plan to go back to them in future).
