I think IEEE, Programmers Guild etc....have won this battle.....unless we get his provision striken off...Consultancy will be a thing of the past....
But I am sure companies will try to find a way to bypass that...but looking at the bill...they seem to have put more restrictions/checks on end clients.....so it may turnout to be difficult to bypass these provisions.

so... I waited for four years before my employer started the permanent residency process. Don't ask me what they were doing before that. They were starting the process for four years. Well they started and the PERM is pending and it will be pending for how long is up in the air.
After reading this forum I understand people have been waiting 3-4 years for labor certification. 2 more years are needed to get the actual green card and 5 more years to get the citizenship. So, I will be hitting 50 by the time I will be US citizen??? OMG!
As an H1B holder of 'extraordinary abilities', with two masters digrees.. I have been serving my term for a salary of a security guard. Can it get worse than that? Ha ha ha
And then you will be glorified in American media (some local newspaper) as american dream come true and how hard you struggled but never gave up. And how generous the country was to you to grant citizenship and make you feel one of her citizens. I aint putting up with any of this crap.

It is a good write up...
The senate and house bill numbers expired with the last congress.
I guess either you have to ask for a new bill or refer to the bill as the bill in 109 the congress etc...
Writing a subject line like 'Please support legal high skilled immigration' would help...
In absence of a proper subject line they would throw a standard cookie cutter letter at you...
Another suggestion is not to talk about border security at all...
Write smaller and more specific to legal immigration..

I think more ideas required. Sooner or later most of the IV members are likely to face this due to GC delays.
1) Say simply "I have work permit and dont need any visa sponsoring" (No need to explain in detail that the work permit allows to work for any company in US etc...simply 'work permit' , and the reason to mention H1B is to divert their attention to another thing thats in your favour)
2) If they ask what kind of work permit...tell them subtly they are not supposed to ask as per law.
3) If they start to dig deeper, then you know that they intend to filter out EAD people.
At that point, if you want to catch them in their act eventually and take them to task, you can lie and say you have green card.Especially to middlemen recruiters who are not going to do the eventual hiring anyway. But only lie orally and not in any written or electronic form. And be as subtle and vague as you can.
If its a direct company trying to hire you, then tell them "I have all required docs and will provide at I-9". If they still insist on finding out about EAD.....I dont know if it will help to tell the truth and be left stranded with no response and no proof to take them to task....or get vindictive and to lie thru your teeth and gather as much proof as possible to arm yourself with to possibly complain when they reject you at hiring stage when they realise you have no GC.
[when I say 'vindictive' its not in the negative sense of the word...]

Just wait for your GC, then start looking for another job and see how it goes. One of my friend thought of leaving his employer the day he got his GC. Guess what, its been almost a year and he is still with the same employer. His employer (Desi consultancy) increased his pay soon after his GC. So just wait till you get your GC and then decide which way to go.

I would not agree. Quite a few times depositing check has hidden clause of enrollment in something. I used to get check from Bank Of America of $10, if I deposit, I am automatically enrolled in their credit monitoring package costing $159 / year.

No - no reasons were given. When my lawyers talked to them, USCIS told my lawyers that they should re-file with my old receipt number.
I then talked to my lawyer and they say that they are going to argue that my receipt date was before they stopped taking premium processing apps. So, the lawyer says USCIS must accept an upgrade request.
Good luck obelix! Hope it is accepted under PP.
Been there, seen it... it really sucks! My upgraded I-140 was approved in EB-3 (should have been EB-2) and the lawyer is still trying to fix it... at least that is what I am told.
It may help you to keep checking from time to time with your lawyer, and ask for copies of emails, FEDEX tracking numbers etc etc whenever they say they sent out a communication. Basically try and do everything you can to follow up on your case.
