Even i have the same problem. I called USCIS last week about this. The officer told me to fix this when i go for Finger Prints which is on Oct 4. He said that it is just a file number and the ASC people will make a note of it and makes sure that they don't assign our number to any one. I will let you guys know more details after my FP.

I got 221(g) when I try for visa stamping. I already have AP. I'm planning to re-enter US by using AP and still wanted to maintain my H1-B status. Recently got married and my wife is planning to attend for H4 visa stamping in couple of months. Since I already got 221(g) and entered US using AP, does it causes any issues for my H4 stamping?

i liked it because it focussed on just Cdn issues, and not primarily Indian, like this one, but there you go.
13 days really sucks.
I've more or less given up hope for the next 2 years. It totally sucks--I missed out by 1 month last year (due to a processing error/delay), now 13 days. Talk about getting jaded with the process.
Anyway, welcome to this board. I recall that you were very active on Grasmick. I agree--I miss the Canadian focus, but such is life.

Yes its approved but your PD is not current how come your 485 is approved? is your PD 2007 or older?

Hmmm, can one apply and get naturalization papers if they lost it? I think there should be a way to get those documents.
I have kept all my documents including paystubs - filing papers, copies and what not.
But the new rules are confusing. If they don't have it on website why ask? Why did the supervisor also support the baseless claim?
I have heard that in every DMV if they do not agree to give a DL - they have a form which they can fill and give it with reason as to why a DL cannot be issued. I think one must insist on document or letter.
My DL expires next year! I am in CA.

Finally got my labor approved in Aug 2006.
Applied from I-140 and 485 in August 2007.
Got a RFE for my birth certificte in August 2008, reponded to that in August itself and now here I am.
Typing all this somehow makes everything seems like it was a smooth process.... I guess it doesn't capture the fustration and agonizing wait.

There are lot of companies who do 90-10 already who are well established. 5% is not going to make any difference with the amount of risk ppl willing be taking.
There are lot of risks going with a smaller companies like DOL and IRS audits.
Lets say there are fines for some reason. Who is going to take care of these things... The costs might look small but in the long the the amount of time you spend saying that 5% and the amount of work you end up doing is not worth it..
Say if you bill rate is 80$ and you will be saying 4$ per hour... which is i fell is better then taking risks..
I actually looked for such company with 90%. I found couple of them but they ended up asking more than 10%. If you have some suggestions please let me know.

Different from all people all over the forums having their H1B visa stamped succesfully in Nogales, Sonora, M�xico (including ME 3 years ago!), this time I wasn't so lucky.
3 years ago I got it approved the same day, but for unexplicable reasons, they asked me to come back the next day, that it wasn't ready yet, so an unwanted day in Nogales I had to spend. It wasn't that bad after all, except that, as many know, you can ONLY pick up your passport after 3pm, so it's almost a full more day to spend there.
This time, on July 29, 2010, it wasn't that good. From the initial data information gathering (finger prints, photo) the lady behind the desk talked over the radio with certain discomfort tone, something about several of us (H1B petinioners I think) being there, that there were like five outside or something. Then murmured some sort of complaint after looking in my I-797 form and checking something in the computer. She handed the form to another guy, who took it aparently to make a copy, then another guy took it again, and she sent me to the waiting area and said she will hand me my form later, which she did after a couple of mins.
When I was called to the booth, the guy took my paperwork, started typing on the computer as always, then slowed down, kept looking at my paperwork, stared back to the monitor, and in this stage a good 15 mins went by. He finally kind of gasped, took a white form from the forms shelves, and started filling it up, in which I was able to read it started "Dear Solicitor, We couldn't....." and then my heart beat started rising.
The conclusion was that, they didn't have my approval notice I-797 in their system, and that they couldn't finalized the approval of the visa. He said they notified whoever the hell they needed to notify, and that it would take 3 or 4 days to get what they need....
Well, I said, this form was approved on April 5, 2010, almost full THREE months ago! How is this possible?? Well, there's nothing I could do, he said. I said, I live in Tucson, how can I stay around for 3 or 4 days or who knows how long more?? He said I won't null your previous visa and you can go to the border and try to explain to them what's happening, they will know. I said, I don't think so, they are square as can be. I asked what would happen when they get what they need to get the visa stamped. He said they'll contact me to the phone numbers and/or the email I left as contact info. I said, how am I going to know when you call me if those phone numbers are in the US and I had to stay around for 4 or more days?? He said I'm sorry, I don't know.
I left in anger and shock, and went to the border. Clearly, they didn't let me in: No current visa, no entry. They don't care, there's no exception to the rule, there are no calls to the Consulate, there's nothing, no hear, no see, no speak.
I called my lawyer and they said it also happened a couple of weeks ago to another customer, the Consulate ended up calling him after a week. They say they'll contact the Consulate inmediately.
They told me that the office where my application was processed (Laguna Niguel, CA), needed to sent it to the Kentucky office, and that maybe this hasn't happened yet... after 3 months?? really??
I have had 2 H1B and like 4-5 J1 visas stamped in the past and never EVER was any delay of any kind whatsoever.
So they either stopped letting H1B renew their visas in Nogales and none of the employees even know, or they are just going worse and care even less now for visa applicants. This is very aggravating and disturbing.
So please be alert all of you H1B petitioners going to Nogales, send them emails in advance (nogalesvisas@state.gov) to make totally sure they have you in the famous "system". Otherwise you may spend 3+ days stuck in there.

Hi !
Today i am here to share some of my thoughts and feeling with you. Please take some time to read and understand this.
This is about my recent experiece with some Indians. I believe that everyone is proud of their country and not just Indians. I was speechless when I heard the Independece day celebrations in the US with pomp and glory. Is it right to come to SOME OTHER country and celebrate OUR Independence day when there is already so much controversy on the immigration issue ?are we not provoking the Americans by doing so ? One American friend had a feeling that we are invading them coz they see Indians, Indian restaurants etc all over ! then came the news of a temple worth a big fat money recently built.... why this now in this country ? isnt it a better idea to use that lot of money to help our own people in India. There are thousands of children who do not get education the reason being poverty ... so many farmers who are the backbone of any country are commiting suicide because they do not have money to repay their debts. Guys !!!!! our people need help! .... they need money ! India has given us the education and intelligence. We owe something to our nation. Building big temples and displaying our patriotism and religious devotion in somebody's territory is not going to help anyone! Our people are suffering and dying! We can do a little good if we donate some money each year to any social organization which are doing really great in India.All they want is some financial aid which we NRIs can easily do. There are orphanages, old age homes and so many organizations who are already doing great with very little contributions.cant we help them?Guys remember ! India is a great country and we can make it one of the most powerful nations by doing some small contributions. God does not need temples in America..... he wants us to help our fellow human beings who are suffering ! We are among the few lucky ones who have got a chance to come to the US and make lots of money .....cant we help our own people by giving away a little from our own pots ? Every time we go to India we can give a a minimum of $100 ( =Rs 4000 which is a great contribution) to any orphanage/old age home/sponser a poor man's kid/social organization. Please think !
Next thing that I would like to put forward in this forum is abt very cheap behaviour of Indinas here. This happened last week at times square, New York. A big group of Indians sat down on the ground in between the roads and were enjoying a great meal !!!! all the people walking by were watching and passsing coments ...... but it made no difference to this group.... sometime later there were cops in the scene who politely told them that they cannot do that .... and guess what .... these people even disobey the COPS !!!! why cant we follow the rules of this country if we have come here ? What is the image that people will get about India and Indians !

I simply don't understand the logic behind the USCIS laws. They acknowledge that US needs high-tech workers. They've even made laws to make the high-tech worker stay beyond the H1 duration of 6 years. That tells you that they don't want all the high-tech workers to leave after 6 years. Then why simply put them under these 7% country limit. Instead of extending H1 beyond 6 years, they should just give greencard for everyone who is staying after 6 years.

When you are on H1, the real cream is sucked by US citizen (your employers). So most of their money stay with their citizens. Longer they can do this, better it is.

Folks, don't be decieved by this noise coming from DC. These hearings etc are just BS...the NY Times has a better piece, accordingly all indications suggest that CIR IS DEAD!!!
These hearings, if at all they are going to be held is just diversionary tactics. Nothing will come about from the CIR this year. The only possibility is when the new congress is sworn in January 2007 after the new year's break.
So enjoy the warm summer and look forward to a bleak winter.
