How do you know that most of the H-1B's dont have intentions to apply for GC? however you know that most of the guys come here to apply for GC? and you know that personally how?
I am not trying to derail the topic here but unless you can prove that there is a fraud involved in people legitimately converting from F-1 to H-1B your theory is pure BS.

There is no legitimate route from F1 to GC. There is legitimate route from F1 to H1. It stops right there. Personally I don't have anything against people converting from F1 to GC. It is just illegal/fraud.

I contacted Ombudsman last year around this time when I was Current. I just asked to have my case seen before those who filed after me, and whose PD was later than mine, as I was watching otherwise, and feared visas may exhaust soon. They forwarded it to TSC Texas. TSC waited until October to reply (I was not Current at that time), with a standard reply that my PD was not current (they even sent me a hardcopy of October08 VB). It appears they never looked at my complaint, or did not want to look at it, and waited until they could have a easy and convenient reply.
Ombudsman approach is not guaranteed either, but try, there is no cost to it. Replies mentioned above are standard replies to keep you away for at least 6 months. No one can question additional review, so they just mentioned that in it.

I work for company A (Big American company), my EB3 LC and I-140 is approved (PD March 2003). I am in 7th year of my H1b and 2 months ago I got 3 years extension of my H1b visa based on approved LC and I-140.
I got a offer from company B (small American company) and C ( Indian consulting company). I am thinking to join company B they are ready to apply my case in EB2 category but I am not sure about the job security in company B, so I want to apply H1 extension through both Company B and C .
I have two questions:
1) Can I get extension of 3 years from both company B and C based on my EB3 LC and I-140 Approval from Company A.
2) If I join company B now, can I join company C in future incase something wrong goes with company B.
Any help will be highly appreciated.

Thats the best post i have seen for some time... But common sense aint so common.. The system is broken and India-EB3 are just a small sub set who are affected NO ONE else is affected so it's going to status quo for some time unless there is a change of law..
change of law maybe difficult ..I feel the new govt has been a disappointment ..republicans are in a bigger mess ..it will be interesting to see if they try to support immi reform ..I wonder what effect the new tax rules on outsourcing will have ..will the Indian govt have guts to stand up and cancel the billions of dollars in nuclear contracts ?
will the USCIS / state dept have pressure as years passby and EB3 is still in nov 2001 ..lot of uncertainity ...
in the end ..we can do what we can do ..i.e. have plan B and Plan C ready and have minimum fixed investment in a country where you have temporary and unstable status

Well, to clarify few things, I had a typo in my earlier post.
First of all, IV has been always a community for all legal immigrants, not just for Indians. Even though majority of them are from particular country, we cannot acheive our goals by alienating other legal immigrants.
So my post calls for Unity between all legal immigrants irrespective of their country of origin. And we can achieve this by not posting threads which address the issue of particular country only, rather than representing the whole legal immigrants community.
Would you like to see just Indians in the DC rally thereby giving people a chance to call this an issue of Indian community only, or have highly skilled workers from every country affected by retrogession and immigration issues thereby giving it a broader prespective.

We had applied for PR in Canada and were asked to do the final landing process in Canada by end of December'07. So we chose the thanksgiving weekend to land in Toronto.
--Going out of US----
I did an eChecking, went straight to security, the security officer took a look at our Canadian visa and without fuss let us go. We were worried that nobody kept our old I-94, so we asked the flight hostess. She said that since we were returning within 30 days (3 day trip), we didn't need to surrender our I-94, otherwise she would have taken it at the time of boarding.
The landing process went smooth. We first went to customs officer. We had taken an inventory list of our household items. On the customs form, you have to mark the you have goods to follow. He was OK with everything else.
Then we went to the immigration officer- he was surprised that we live in US and asked us that we should move to Canada and avail of the PR there as it is "not nice" to take the PR in Canada and not live there. I told him that I will check out the job prospects there. Then we went to another customs area, where we showed the inventory (2 copies)and they just stamped the list and gave one copy to us. I had also taken cashiers checks to show proof of funds.
--Coming back to US ---
Coming back, the US immigration officers are present in Toronto itself. Which is nice in the sense that when you land in the US, you just walk out of the airport.
We were sure of which line to stand in - visa holders vs. GC. We stood in visa holders line. The immigration officer seemed to be aware of Adv Parole and EAD and asked us to go to secondary inspection.
We went in another room for secondary inspection. The officer told us that they have new rules in place for Adv Parole and they have to verify all the records etc. It took about 20 minutes and he gave us a new I-94 to our surprise. We asked him if he wants our older I-94s back and he said "oh yes". So we gave the older I-94s to him. Now the I-94 that we have says we are Adjusting Status - so I am guessing H1 petition is no longer valid.
The whole process took about 45 minutes including wait time. 15 minutes for security. But we almost missed out flight.
So guys if you have EAD and AP, be at the airport 1.5 hrs earlier to boarding time!

Because there is nothing in life that is strictly FIFO.
Just as success in life is not always connected to your education, hard work , reputation , dedication , knowledge , wisdom , truthfulness , steadfastness or any other virtues.
There is some unknown quantity , some people call it luck , some call it God's grace , some people call it just being in right place in right time.
So just take it with a pinch of salt and suck it up. Save yourself from blood pressure :)
Participate in the rally if you are willing and able to.

1) I was working at a client place until last month, so employer was making money and paying me 7k.But, now the contract has ended.He gave me the offer letter for 84k but the LCA minimum salary is 52k.So, by law how much does the employer need to pay me next month legally.
dc, the 52K stated in the LCA is the "minimum". The purpose is so that the labor dept knows that employer A is not a sweat shop and most importantly not artificially depressing American workers wages.
Since you're making waayyy over this, I don't think you have a case. By law, you're supposed to be paid what is stated on the offer letter.
Just a warning, since you've already rattle the snake, you need to be careful since if employer decides to terminate your H1B...you're done. Since this will be a cluster F, I would clandestinely do a H1B transfer to employer B and deal with whatever afterwards. Good luck.

3 of my friends went to mexico and got stamped in this month. they got the passport same day. it looks like this is only with indian consulates to eliminate some fake cases.

My suggestion is to file MTR with Fee even it is service error.
You can go for InfoPass appointment to bring into their attention but MTR is a proper channel.
I know it is frustrating to spend $585 for their mistakes.
The reason for denial for me and my husband and son is that visa numbers were not available at the time of 485 filing.Iam the principle applicant.Our 485 Receipt date is August 9th 2007.Our priority date is july 27th 2006.
I had been through 2 RFEs in Jan and Feb 2009 for medical exam and Marriage certificate(memorandum of marriage).Then my case was transfered from Nebraska to National benefits center in march 2009.I was called for an interview on June 2009(all 3 of us) at Fresno,CA.My interview went well.After i got back home, on June 4th i received an e-mail alert from USCIS that all 485s were denied.
