Thanks texcan. My Employer already charges me a Grand/Month. So, there is no question about split ups...but I'll do some searches on state insurance board.
By the way iam in TN state...If you know any place to start looking, I'd welcome your suggestion.

My perm labor applied in May 07 got denied and here are the reasons that DOL provided. I hope the following info I provide might be useful/help others to not do the same mistake as the attorney in conjunction with HR did.
Graduated with Masters in 2003, worked for 19 months with a company. Moved to my current company in April 2005. Labor process got started in Dec 06. Filed in May 07. Got denial letter on Oct 2, 07.
I have enclosed the attachments that indicate 1. job description 2. section of perm application 3. DOL denial reason
After this failure was escalated to bigwigs, they are rooting to help me in all the possible ways and want to know the "wording of requirements" that should be spelled out to avoid this in future. Plz note that I have used 4yrs of my H-1 and have to start all over. They understand that and are all in to help.
From the forums, i've been reading that if a job description says "Required: BS+5 or as an alternative MS+1", you will be good to go for EB2.. but clearly my labor got denied as DOL counted BS as 2 and MS as 3 and said 2+5 != 3+1. And this is for fact as my attorney asked DOL to explain/clarify.
Please help me here with my job description. Would it be ok to completely ignore BS+5 in the new job code under which my labor will be filed. Also I am hoping that my H-1 has nothing to do with the new labor, or should I require a new H1 since its a new job code.

I have a similar situation, where my I94 is getting expired in july'08 due to my passport expires. I have valid visa till sep'09. I got my passport renewed and got new passport. Now I need to extend my I94 either here or go outside USA, like canada for get new I94.
Please suggest me what needs to be done If I plan to goto canada and come back. How many days do I need to stay in canada to get new I94. Any help is appreciated.

I did E-File for both me and my wife on June 15. We did bio on July 12. My wife's EAD got approved on July 23.
I got RFE for missing or wrong pose for photos on August 4th. I sent photos and received on August 7th.
Still waiting.

Best bet is to go for H-1B stamping at a consulate. If for any reason stamping is denied then you can use the Advanced Parole to re-enter. This holds true even if your I-485 gets approved while you are abroad. By the way if you maintain the same employment you continue to be in H-1B status even if you re-enter using AP.

I had an RFE in I-140 because USCIS said my Labor was not approved (which obviously was a mistake). My RFE was responded back with the proper Labor approval documentation in October 2007, but still it got denied on January mid 2008.
In result of this, I-485 got denied too. My lawyer will work on this and will file an MTR (Motion to re-open) if needed and says there is nothing to worry about or panic as this is a mistake made by USCIS.
But, this thing atleast helped me know that what was happening with my I-140 and that's a good news.. Now I will be in loop the whole time.

we are working right now as i speak (just read an update in case you are wondering about the late night!) to get some administrative fixes and bring relief to those that missed the july bus- and to everyone stuck on AOS for prolonged periods. these kinds of measures and recapture need support across the board and it's important to engage lawmakers at the state level. so please join your state chapter- consider starting one if it does not exist- and meet legislators and their staff over the next few days.

Please be aware that your old employer can withdraw a petition. USCIS honors it. They send out a communication when that happens and after that you respond with the AC21 letter of support from new company.
