Atleast she is trying to help her clients who are stuck outside for lack of visa appointments. Her plea could be genuine and I not sure if any other Law firm would have had the same attitude towards this situation of their clients.
At least she is attempting to make a difference for her client, so cheers to her.
Also on the same note this request for delay could be just to cover her inefficiency in finishing the filing for all her clients by Aug/17th.

I am applying for H1 & H4 Extensions so that we can get it stamped during summer this year which givesr her atleast 3 years of valid visa to enter into USA. Then we can apply for advance parole for 1 year. This is what we are thinking currently.
Consulted with attorneys and they advised applying for extension of h4 only.. She had already travelled on AP last year and so I am not sure if it is okay to travel on H4 next time.. Still trying to validate this (Any ideas on this please??)

If i enroll back in school through open university and take courses that counts towards my graduation will that help in convincing the Visa officer that I have not abandoned my intent to earn my masters degree....

This should help as a backup plan if at all they ask you about u r MS ...!!!Bottom line is show ur intention to achive for what u came for without jeoperdizing u r job.

My last two supervisors are still with Company (www.satyam.com). They are not ready to give the skillset letter.
But my L1B documentation has a resume and it has all the skillsets and that is submitted to USCIS.
I can show all the US Based w2 and Paystubs.
But only one manager is not with Satyam and he can provide only 2 years of experience since he worked only for 2 years or little over 2 years.
Do you think it would help. The company also sent me an email this morning that they would'nt giveme the skillset letter.

You know why AILA doesnt know jack about this?
Coz they are threatening a lawsuit. And I am not saying that is the wrong thing to do. USCIS and DOS manipulation deserves a Tsunami of lawsuits.
But the thing is, if anyone knows ABC of litigation, when you are in negotiations with a party (or parties) threatening lawsuit, you dont blabber away details of what is going on and what happened so far. The conversation is thru lawyers only. The plaintiffs and defendents take a back seat and let the lawyers do negotiations without divulging vital information. That is exactly why USCIS is not telling anything to AILA. Nothing personal there, but that is just how lawsuits work. I dont think Emelio Gonzalez would even say "Hello" to anyone in AILA coz there is a pending lawsuit. USCIS must be talking to AILA thru its internal counsel (their own government lawyers for defense from lawsuits).
So it makes sense why AILA doesnt know about this and thinks its "fluid". They are not misleading. They are just sitting at the wrong table wheras Immigration Voice was sitting at the de facto negotiation table (Read the businessweek and its *hint* about white house talking to immigrant groups. Which immigrant group other than IV represent hi-tech workers ? )

My lawyer suggested the same thing & have indicated that they ll not charge twice if the app has to be submitted again. They are concerned about the suit, and want to ensure that if a class action follows, we are eligible as members of the class to the extent they can define it now.

I have no idea what your point is. There are people with different skill sets, different education backgrounds and different years of experience. It is basically what the position is for, sometimes I get letters saying I am overqualified for a position, which is very true. Bottom line is this, we are not qualified to judge what is crappy and what is not. In my team, I have guys who just have high school degrees who excel better in my team and listens to me than extremely educated guys and gets more work done, than people who have multiple degrees and higher qualification like I do. Being a manager, I do look for qualification to an extent, but thats just a very miniscule part of the whole picture. The rest is experience, attitude and being personable. I spend 4 years doing my engineering and 2 years doing Masters in Comp science, I still came out of college and studied in the job and had to go to institutes like NIIT to actually study what I am working on. So I think everybody is eligible for Greencard as long as you lawfully have come in to the country, period. Some take more time, some take less time, but I think we have all earned it. peace out.

I will have to go for spending 1500 $ for premium processing ? what is your opinion . I have my wife and son involved with my GC process too. Do you think it worth those money above and beyond 10,000 I had already spent.

There are little problems and there are big ones, but the view regarding the size is always subjective. If person cannot get EAD in time and get fired+loses GC, it will be a big problem for someone. I think people can discuss what they want. Maybe IV can create a FAQ for EAD/AP questions as a lot of them are the same? People who want to focus on the big issues will be able to make big changes, but we cannot force people to focus on the issue we think are the most important to us.

you can get the transit visa at the dubai airport. just ask at the customer service booth. they will guide you to a travel center, where the person making the hotel reservation will sponsor the visa for you. The hotel actually sponsors the visa. it will all be done in less than an hour.
