just an alternate approach based on what my parents and in-laws have experienced........
they have just said to the consul that our son (daughter) and his (her) family lives in US and we visit them from time to time to meet them and spend time with grandchild......hence we request a tourist visa.......we have the following ties to India and here is our financial position snapshot
this has also worked......no specific occassion (birthday, graduation, housewarming etc) asked for...

Also, is there any difference (pros and cons) between e-filing and paper filing? Is finger printing required in both?
As you might have see in the same forum, if you have patients to read and understand one single page of explanation of how e-file works you should be good to go with e-file and it is quite easy; every thing is outlined before the start of any form in the e-file process.
I e-filed and i got finger print appointment...it hardly took 5minits well before the appointment date to get it done.
No confusion with paper file too; uscis will let you know what to do after they receive paper application.

FWIW, if your parents are here on a B1/B2 visa, then you cannot claim them as dependants. The whole idea of a B1/B2 visa is that you are a visitor to the US and have stronger ties to your home country. OTOH, if they have a status that's independent of yours (which I dont think is the case) then maybe you can. I suggest you consult a qualified accountant on whether they qualify to be your dependants. At the end of the day, even if something goes wrong for you, having an accountant represent you is always better. That way you can say that you did what your accountant suggested and then beg for forgiveness.

The cut off date for EB3 china is 08-Feb-03. Your PD is 21-Feb-03. So your PD is not current yet. So you are not quite there yet.
Look out for May-08 visa bulletin whch will be published mid April and see if the cut off date moves beyond your PD.

Well, as most people say here, you need to get another attorney. The one that you have is not "the brightest bulb" on the block.
Also, as some people suggested "send in your documents", I am sure they mean that send it through an attorney. REMEMBER your case is in RFE Status. Dont try to send anything by yourself. You will need to get a new attorney to draft a letter in response to the RFE mentioning the correct statues in law. In the event you send this stuff by yourself, and if your case gets denied, then the appeal process is very painful.
If I were you, I would get a new attorney FAST. The longer you wait, the harder its going to get for a new attorney to file a response in time.

Continuing this thread on a similar but not same issue. I efiled my AP renewal for myself and my spouse today. System told me to send the supporting docs to Nebraska even though I live in TX. ( Guess its because my 485 is rotting there). This is my 3rd AP renewal. The issue in my case is, I was able to print the confirmation receipt but I am not able to add them in my portfolio in the uscis website. its says receipt # not found. I have my travel dates confirmed for the beginning of november. Do you guys think that Nebraska will send my AP before that. Dont have a H1 or old AP to fall back. This is my only option.

Well said. I think you did the right thing in saying what you did, because you need to stand up to the anti-immigrant sentiment. Believe me, no offense is taken from your reply. It wasn't my intent to come off that way originally, and I apologize if I offended anyone.
The reason I brought up H1B visas is because, at least to my understanding, the issue of retrogression issues with green card holders has to do with the quotas and only applies to people who come over on H1 visas (mostly H1B) and apply for a green card.
For my wife, the issue is either a delay with USCIS or the FBI name check. There is no quota issue because I'm a citizen.
I'd also like to clarify what I meant by abuse. From my side, as a citizen, I was once told that I would only be paid 50% of what I was offered the week before, at the same customer, because I was "competing with other firms who employed H1-B visa holders" and charged much less. The customer really wanted me back, and explained that it was purely financial. The problem for me was that 30% of my rate was for expenses, so this amounted to a real cut in my salary by over 80%. I knew that the H1-B visa holders had to have been hired at illegally low prices under prevailing wage laws. But could I do, sue the competing companies? I didn't even know who they were. Pretty soon all the agencies started doing the same thing. So in 2002, I made less than 20% of what I did in 2001.
I then went back to being a regular employee vs. an independent, where I got to see a whole office laid off, including people who were brought over here, just bought a house, and had kids. Those people had H1-B visas and were applying for green cards. It was aweful.
Anyway, I brought up "employer based" immigration, as I called it, because retrogression (again, as I understand it) focuses solely on employment based immigration. I'm trying to see if there is a common ground in different communities affected by current immigration policies, including family based immigrants and American workers who've been subjected to the kind of low-balling I experienced.
For my part, I am completely shocked at what is going on with immigration. I had no idea how bad it was. But when I saw the aftermath of Katrina, I started seeing immigration as part of a larger, systemic problem with the Department of Homeland Security. I think there is a real opportunity for a general set of principles that a very large (and very motivated) group of people could agree upon. If a mjority of people feel that "employer based" immigration is really the issue, it would signal to me that this could form part of just such a set of principles.
To be clear, I'm not suggesting this group change its mission, but I would like to see if there is an opportunity for coalition building.

There are already thousands in this situation and if there is no legislative action there are going to be many thousands more. While we will eventually get green cards all being well (though it might mean waiting a while) these children are literally in an immigraton no-mans land.

Since your wife petitioned, they are asking you to prove you are married. One way to prove that is to show you filed your income taxes jointly. If you were married, you probably used married/filing jointly or married/filing separately status. Send them those tax returns.
By they way, if you are an adult in the US, you should file a return- even if you did not earn a penny. Very few exceptions for not filing a return.

As far as I know, you can always take leave without pay and studying is a very good reason. I'm right now on leave without pay and pursuing my master's for 7 months already, my attorney said it's not a problem at all (hope he is right).
I guess the leave of absence policy varies with the company. My company will only give a max 6 months leave of absence so there is no way I can go for a 2 yr. full time MBA on leave of absence.

I do not understand this all process...my understanding is
At labor stage All Education and Experience are validated and then approves Labor....then comes 140 where they check Ability to Pay etc...etc...guys are getting RFE about their experience and education..at 140 that I do not understand....as read many threads I see that I-140 is purely about Employer....
If anyone knows why guys get RFE at 140 stage about their exprience and education please let me know.

First of all entering a country illegally is wrong. It is a crime. After committing an illegal act, seeking protection by talking about civil rights, liberty etc is absolutley unfair. Every country has a right to enforce its borders.
Will it be ok if 10 million Pakistanis enter India, stay and work illegally? Please pause to think. Let us be fair!
Might is not right! Just because the illegals have a HUGE NO. they are arm twisting the government and also holding people like you and I to ransom. They are the ones who are preventing anything good happening to us. I am least bothered about what they do, till it affects the legal immigrants.
Why should we fall under the ambit of the CIR? In what way did we violate the process? The issue is simple ---> The illegals have all the money,muscle and vote power but 0% of the law on their side! In our case we have neither the money, nor the muscle or vote power, but have 100% of the law on our side.
I only hope Arizone wins the major legal battle too!
