    Hi,

    I am in a similar situation and would like to know what are the chances of my new H1 getting approved if I am changing to IT. My previous H1 was in Electrical and my education is all in Electrical (both undergrad and masters). Now if I change to IT, can I transfer my current H1? Or since I am changing from electrical to IT, does it have to be a new H1.

    It is called soft LUD, which happens most of times, when there is no real change in the wording inside that link but still you can see a new date. It may happen sometimes when they reindex or restructure or something in their file/database system. An LUD does not always carry description change in your case/file. I hope this helps.

    Okay I registered online. It shows my I-485 application was last changed on 01/04/2008. How do I see what was changed, as when I click on that line it takes me to the page where it describes when my application was received in August'2007 etc etc... doesn't mention anything about changes done on 01/04/2008 .

    Thanks for all your responses.

    I will be travelling to INdia during the month march/april, get my passport stamped and then proceed in US for I-140 & H1-B extension.

    Are there any risks involved here? My current H1-B expires in August 2007.

    tough to tell if there are any risks. Nobody can guarantee H1B visa stamp even if you have USCIS approval. Embassies have the power to overrule approval decisions. However if you are working for a legit company, your educational qualifications match the job requirements and are being paid salary as per your prevaling wage then you should be ok.

    After you come back you have to pay a lot of money to your lawyer-- 140, h1b extn... :(

    I received RFE e-mail today morning from NSC ,but wont know the nature of RFE until I receive the letter from USCIS.

    Ours is the EAD online renewal filed on July 02nd 2008. RFE is only for my application, nothing yet for my wife's EAD application.

    I am surprised your PD is current and why USCIS is requesting evidence for the EAD? instead they should process your I-485 and be done with it.

    anyways USCIS processing has no logic sometimes, or may be the EAD department dont know whats happening is adjustment of status department.

    Please share the RFE details with IVans once you receive the letter. Hope it is as simaple as photo ID or missing signature etc. I was trying to google EAD RFE information ,but couldnt find much except for the simple requests like address, Photo, missing signature etc.

    Hope this information helps.

    I didn't want to get to the specifics. But since you mentioned it let me explain.

    1. H1B guys once left US and live in India (or their home country), are NOT required to file US taxes (after the current tax year). But US citizens are required to file US taxes wherever they live permanently.

    I infact wanted to stress the words "wherever he live" in my last post (maybe I was not clear).

    2. Tax Credits don't give you enough benefits. Especially if you are moving to a country of lesser tax. To make it simple, lets say one rich guy moves to Bermuda for good, but keeps his US citizenship. He pays 0 tax on his income & capital gains in Bermuda (tax haven), but ends up paying most of US taxes (even after filing as a NON resident). Now on the other hand if he threw his US citizenship away before moving to Bermuda. He pays no taxes in US and in Bermuda for his income and capital gains.

    So lets not generalize. For most of us it doesn't matter, since we plan to stay in US permanently. But if one genuinely plan to stay outside of US forever, you might want to look into things like this.

    Again tax is just one of many items. I don't want to write an essay. if you have some specific questions on this topic PM me and I will point you to right direction.


    Perhaps you did not notice that I mentioned most H1-B visa status holders in my post. Since number of H-1B visa holders that go back for good are small, therefore I mentioned most. I think that should explain that.

    This is what I wrote in my post
    This is true for all green card holders and most H-1B visa status holders as well. As long as one is resident US person for tax purposes, he/she has to report worldwide income.

    Also, you, conveniently, left out that green card holder HAS to pay income tax on worldwide income no matter where he/she lives or work. This was main my point that for tax purposes there is no difference between green card holder and us citizen.

    Let me repeat one more time, so that you can understand. There is no difference for tax liability between green card holder and US citizen. By not taking citizenship, green card holder is not going to save on taxes as long as he/she is green card holder.

    Without giving you details, there are many legal ways to reduce taxes. BTW, I do have finance (and comp. science) background.

    I have also changed company as our US Division was merged with another company. I transferred my H1B to the new company. I have I-140 approved last year and filed for I-485 in July2007. My old company is not going to revoke my I-140. I asked my attorney to file for AC-21 with the USCIS. This is his reply. What do you guys think about informing USCIS and sending offer letter to them without RFE or NOID?

    "It is not required to inform USCIS of your job change and your intent to use AC 21. You have an approved I-140 and I-485 has been pending for over 6 months. I have had clients who ported under same circumstances and received their greencards without issue. Also, there has been some incidences of I-140 being revoked especially for people from India. I am hesitant to submit such a notice to USCIS as I don't want to draw any attention to your case with the current revocation atmosphere."

    Interesting. Looks like the COs maybe targeting specific community??

    Hi Guys, If any one else faced a similar situation.


    My wife gave her road test on April 04/05/08 and passed the test but DMV failed to issue her driving license as they could not find her I94 in list provided by USCIS for clearance for issuance of Driving License and the officer who took her road test explained to us that they sent the query to USCIS and asked us come back in 15 days, and when we went there for the second time a different office but same story and this is going on since then, I called USCIS today ( the number provided by DMV for USCIS ) to ask them if they have my wife's ending application for clearence they say that don't interfere into driving license issues and we have deal with state of Georgia.

    DMV office is not accepting any phone calls to update us with he status of the query, so we have go there wait for 2 hours and get the same response back.

    My wife is currently on H1 valid until Oct 2010.

    How did you find out what to answer for "Pick the service center where your I-485 is currently."

    I have 2 options -

    (a) Since the 485 receipt number starts with "WAC" and I found in this forum that WAC stands for 'California Service Center' I can pick "USCIS California Service Center"

    (b) The current online status for the 485 is - "On March XX, 2009, we received your response to our request for evidence. This case is being processed at our NEBRASKA SERVICE CENTER location....." and so I can pick "USCIS Nebraska Service Center"

    or should i pick some Field Office? - I have no idea what that means.

    Sorry for the confusion but I am not on H1B i am on my EAD already for over a year now. In that case, I guess I can be employee of my own company. Plus even if I quit as a CFO, the problem is if USCIS wants they can see it on the paper that I quit the role, so whats the point quitting. I may be wrong but just a thought.

    People here need to read posts before responding. Clearly Eager Immi is not the one doing labor substitution. Why does everyone want to attack at the first chance before even looking at the facts? Are people making themsleves feel better by pointing fingers at others?

    heh Eager Immi, first off your employer is not blackmailing you.....infact you want a free ride. If they did your labor and I140 they have every right to ask you to join their workforce.

    Secondly, no one has forced you to do anything. If you do not want to join this new employer DON'T. Stick with your old employer.

    You are being selfish here by wanting the new employer to sponsor everything for you while you maintain your "cushy" job with your client.

    Please look beyond yourself for one moment and think from the new empployers perspective.

    Hi Friends,

    I have a similar situation, where my I94 is getting expired in july'08 due to my passport expires. I have valid visa till sep'09. I got my passport renewed and got new passport. Now I need to extend my I94 either here or go outside USA, like canada for get new I94.

    Please suggest me what needs to be done If I plan to goto canada and come back. How many days do I need to stay in canada to get new I94. Any help is appreciated.

    THIS PROCESS IS CALLED DEFERRED INSPECTION - no need to go out of the country

    Step 1: Apply for a new Passport. After receiving passport see step 2

    Step 2: Go to link below and download the pdf file to find the site/airport location which is closest to your current physical location

    Step 3: Call up the site directly and fix the appointment. Go with Old Passport, new passport and all visa documents and I -94

    Step 4: Explain the situation to the officer and he/she should be able to rectify at the time of appointment. Officer will put the new date on the existing I -94 and update the system and on the card itselff. No new I - 94 will be issued.

    It is not the job of the lawyer to say why you are a better fit for the position. It is the job of the company. The lawyer is not the one hiring you, it is your company. Unfortunately, with an MS+0 experience, you are in a position where it is highly likely that your labor would be denied. You need to be able to show that another person with an MS+0 who does not need sponsorship is not as good as you. Even if they are reasonably as good as you, it will not be approved. See if you can get the requirements modified.

    Hold on lady! (I am not calling you a woman, its just a colloquial slang) Stop making assumptions here. I have seen many a MS+0 get approved. It depends on job requirements. Education is just one parameter. Skills and domain of expertise matter too.

    I never used my H1-B, I worked for another company using EAD, that voids my H1-B status so I used AP to return.

    What do you mean it is not lawful entry ??

    For I-485 under employment based category, applicant can avail 245(k). Under this section applicant can adjust status to Permanent Resident as long as out of status since last lawful entry does not exceed 180 calendar days.

    For this purpose only, the last entry counts that was made on non-immigrant visa. What was your previous entry with visa? That will be your last lawful entry for I-485 purposes.

    Using AP is valid entry, however, it puts the applicant is parolee status.

    I suggest that you follow up with your attorney.

    This is for future employement. How much you've got paid before deosn't matter as much. The key is to show evidence you can get paid in the future.

    "Ability To Pay" is determined from historical records of employer's strength.
    hence it is the MOST important thing and poster is on right track that he worries about it.

    By the way have you become a member of state chapter? Have you contrbuted or planning to contribute in recent funding drive?
