The lawyer at his company (hope is a good one) should easily put on the table various options to make the Eb1C work for him in consonance with the company mgmt. Hope that works for him.
As for his wife, even in the worst case even if he comes on a H1, the argument that his wife cannot work because she will be on H4 is not tenable at all. If she has that good a work experience she should be independent of her husband's status and stand on her own feet for job/immigration purposes. If he has to get thro' H1 quota issues so does she!

This is not a personal choice, it's more of how much risk you want to take. Most of us have waited so long for the GC that it feels better to take the loss and stay with the employer for another 6 months.
I wish IV could get us a clear cut clarification from USCIS...
The safe rule of thumb is that the employee stay with the sponsoring company at least for 8 months after getting GC. This is something many lawyers recommend.
However, there are many cases when people have left the sponsoring company immediately and gotten their citizenship, while others may have had to provide additional documentations.......the choice is entirely personal.

Hi,
Just trying to see if anyone is or was in the same boat as i am.
For GA license renew ,DMV officer had me go through the SAVE system as the EAD start date was in future.
Now the question is how long does this process actually take and did anyone face any issues with SAVE verification.

To be honest this a very vague area of the law. I have seen people switch to unrelated job getting GC's without any issues and also know of one who did everything by the book getting an RFE. Just talk to your lawyer and stick to what he says, we end up over analyzing issues and miss the bus. I say this because i have done everything by the book so far and am still waiting. I hear that they are getting more particular about AC21 these days. Do what you think is best for you and once you take a decision just go ahead.
Well things have been fine but now things are changing. You can see people getting RFE on employment even if he/she does an AR11 address change.
AC21 RFEs are now very specific with job requirement, experience, education.
Looks like the original poster's job MAY be similar but it is better to check with an experienced Attorney

Can you please elaborate, how can he apply for Green Card on EB1 category without even waiting for H1B to L1A COS approval?
In order for applying in EB1 multinational executive, doesn't he has to be in L1 status?
H1B to L1A IS possible. I am 100% positive about this. He can come back as H1B, his wife as H4. Then if they can prove that he has managerial experience outside US for 1 year, he can get a H1B to L1A Change Of Status. His wife can become L2 automatically (they need to apply this COS together).
Then she can work on L2 visa as a Walmart store clerk to MIT professor. Since L2 has no restriction. She only has to get EAD, then apply SSN(if she doesnt have one).
His can apply for Green Card on EB1 category without even waiting for H1B to L1A COS approval. If they get any RFEs they can provide any evidence needed. If their EADs come earlier than COS, then his wife can work on EAD itself.
All options are open for him. Important thing is whether his company will be ready to do all these things...

Thanks chanduv23. At least now I have a time frame I can use to wait. Just in case this time I asked my attorney for the FedEx tracking # so I can make sure it makes it to Mesquite, Texas.

I agree that filing MTR is the safest option - do track your receipts and also contact Ombudsman's office so that they can assist you with your MTR and get it done quicker.

This video has already made the round on Imm Voice a few months back. I believe that is when we put our own video though maybe not countering one on one, but at least the idea came up to put a video from the highly silled legal perspective.
