yeah I realized it doesn't make any sense (wishful thinking). I guess the only option I will have then is to go for CPT as Phani suggested...! I was wondering if there were any other options out there...
I don't think you can use CPT after graduation. Only OPT can be used after graduation unless you haven't already used it completely.
However using CPT as Phani suggested cant be used for full time when school is on. only for 20 hrs per week.
Also so long you need to remain in school to need to take full credits (except last semester)

I am posting this question on behalf of my friend.
My friend was laid off and his company is going to cancel his H1 soon. His company is giving a return ticket ONLY for him. They are refusing to give a return ticket for his spouse and son. Can somebody point me to to some USCIS H1 rule that would state that the h1 sponsoring company is responsible to pay return ticket for family, who is on h4 visa sponsored by the company. Or advise if the company's statement is true??
A quick response would be appreciated.
Check LCA application form: You can find that emplooyer is responsible for employee rerutn ticket.
Check (i mean recall) H4 application submitted for H4 Visa: Here your friend might recall that he pledged to visa officer that he would support his wife./son.

Do you agree that ROW EB2 has the same qualification as I/C EB2 (& EB3). While I/C EB2 wait for 3-5 years, ROW EB2 gets GC in a year. Do you think its fair or do we need to ask them to wait until EB2 guys who are waiting more than three years gets the GC.

But EB3s may start thinking that since any solution for EB3 backlogs are right now not visible, people who have been waiting for a long time would start to think, why not use the spillover numbers to clear the backlogs. I think that was ncrtpMay2004 member's viewpoint.
In this case, no body eats into anybody's quota alloted for a fiscal year and the extras if any are left and are used efficiently must be equally spread across all categories in order to clear the backlogs.
Hopefully you understand that everybody are frustrated and are trying to see how the solution can be achieved. I remember a thread where there was a thread with EB2 members screaming quarterly spillover is not occuring. We all know the answer we got from USCIS for that query which is quarterly spillover is indeed happening. We may not agree with that answer, but when USCIS themselves do not have clear picture of their backlogs, we doing predictions are useless.
Unfortunately, IV members has undergone this split between EB3 and EB2 these days within the members. Not from the IV Core, who has been trying to preach there is no way solution can be achieved just for one category/country. There was another thread which went with calculations which paints rosy picture for EB2 giving hopes that they may see dates moving well into 2007, whereas we heard from the actual source(DOS) in january bulletin that even with spillover the dates will reach only up to Nov 2005(max).
So hopefully the members, stop our own calculations and predictions when we do not have proper data to do so and start the focus on grassroots approach to go by IV Core's initiative and give it a push.
Everybody are frustrated and hopefully we can stop this bickering over category and country to start channeling our energy into meeting lawmakers etc. That is the only way it might work in my opinion.

After reading all the articles on this topic out there - it scares me that they are only talking about illegals. This is in tune with the comprehensive immigration reform effort of 2007 - the one that was out to do more damage to the legal community waiting in line than good.
I still feel we need to do a rally and more to make ourselves heard... We can only *hope* that legal immigrants in line get a fair deal though coupled with illegals - if and when this happens...
As always we hang by a thin rope of hope - nothing new :(

Hi,
Per the latest AP filing instructions, the AP renewal application shuld be sent where the I485 was filled. So if it is Nebraska, you have to mail it to the Arizona address provided.

I think we are saying the same thing differently.
You filed your I-485 based no where you live. For people whose petition receipt starts with LIN (i.e. Nebraska) - the address is a Phoenix address.
Just read the instruction from uscis.gov and you'll figure out exactly what you need to do. They have a pretty simple if/else algorithm in the instructions as to where to file - just follow that algorithm to the 't' to get your address.

I've to go to India on a emergency trip for 15 days and comeback stamping my 9th year extension from Kolkata US Consulate . Now i hear peoples are stuck for months @ PIMS.
I heard that Canada and Mexico US consulates at least let you know if your petition is visible before you leave US. So if i check with them during the day tomorrow and hear 'yes' - can i assume that the extension Petition will be visible at Kolkata,India consulate as well ?

There are two provisions with respect to STEM in Bill Frist's bill and please do not confuse the two of them
One states that if you have a Masters in STEM from a US university and have a job offer, you can directly apply for Adjustment of Status but you might still be within the quota
The second one states that if you have Master in STEM from anywhere and you have worked for 3 years in the US before your apply for your green card, you will not be within the quota.

How can an MBA improve your career?
My (and all my friends') I-485 are EB2. So if we must be employed before I-485 approval, then how about between I-485 approval and getting the physical green card? Can we go back to school full time? I heard that sometimes it takes more than 6 months to get the card after I-485 approval.
I searched the forum, many people seem to be interested in going back to school during I-485 pending. (who does not want a better career and money??). But there is no definite answer so far.

The U.S. Department of State (DOS) released the August 2006 Visa Bulletin earlier today (July 17, 2006). The Visa Bulletin contains a significant change affecting employment-based, second preference (EB2) cases for nationals of India. As of August 1, 2006, the visa numbers for EB2 for persons chargeable to India will become unavailable. This means that as of August 1st, persons in this category cannot file their I-485 cases for adjustment of status within the United States, nor proceed with consular processing to obtain the immigrant visa abroad, no matter what their priority date. It also means that those with pending I-485s or consular processing cases cannot move forward to approval after July 31, 2006 until the priority dates become available again for that particular individual or family. The movement of priority dates is expected to change once more immigrant visa numbers are released and become available starting October 1, 2006 or soon thereafter. October marks the beginning of the 2007 fiscal year (FY).

Like I said earlier, i got my returned FP notices in mail. So ANYBODY WITH SUCH AN ONLINE STATUS, CAN YOU TELL ME IF THEIR ONLINE STATUS WILL CHANGE BACK TO ENDING AT ALL??
