I was told that they will usually let the first time slide but if you miss a second appointment without trying to reschedule they will then consider your application abandoned. Try not to worry to much- you should be fine!! Best of luck to you

I had also got the same reply from them (20 working days). It took them about 5 calendar weeks to process my application (I sent in my app on Dec 27 and received the passport on Feb 5th). Hope this helps.

did the statuses of your 485s for either of you guys indicate anything other than Pending?
Just get ur attorney to file MTRs and u shud be fine.
I know its unwanted tension and expenses. But file the MTR and relax.

TX DMV won't issue a drivers license unless you have 1 year remaining on your I-94. If you move to Texas when you have less than 1 year left on your I-94, you cannot drive in TX.
Do they accept EAD? How about thosse with pending 485 status?

:-(( I am in a fix. I came to Chicago on a B1 in July, 2007 which was stamped till 4th October. Applied for an extension in September and the case is still pending. I had requested for an extension till January 4th, 2008 . Now meanwhile I happen to be married to a US Citizen and we have filed I-485, I - 130, I-131 & I- 765 and got the receipt. My queries are :
1 ) Does the receipt delivery imply that the form is complete and valid ?
2 ) I need to travel to India for my traditional wedding ceremony and since there seems to be some astrological predictions as in there are no auspicious dates after March 10th for the next two years ( might only hold good for my caste :D ), my wedding fixed on 9th March. I have the receipt of I-131 as on 12th December. Now I dont see much hope of the process getting done by February to travel for the shopping and all the preparation. What can I do at best to make sure that I manage to make it to my wedding and donot make a mockery of myself ?? !! Also, I am presuming that my I-485 pending status allows me to stay after my B1 expires this January 4th ( though it is still pending :D )

Your lawyer is right! According to the USCIS you cannot file premium if any of the following conditions exists with your application:
-- a second I-140 filing, if an initial I-140 remains pending
-- a labor certification substitution request
-- a duplicate labor certification requests (i.e. those cases where the original labor certification is not included)
So If I have already approved I140 and now I am trying to substitue to a new one can I do premium processing.

Hi all,
My wife just entered the country 2 weeks back and is looking to file for an H1... I just saw the updates about the number of H1Bs not being filled... Is there still a chance for my wife to apply ??? Can somebody help me find an employer/consultant who is ready to file H1s this year.... ?? I know its a little late.. but I also believe in miracles... :) :)

Well - if your wife has a project in hand that she can start from Oct 2009, and has necessary documentation and support, she can get the h1b. These days they are very strict about visa gouging - the idea is to stop gouging visas and have them in hand for candidates who have genuine employment ie say someone already doing job on OPT and their company is willing to extend the job by sponseringh1b.
Alternately there could be future jobs for Physicians where employers can interview candidates finishing residency and fellowship and extend a job offer with s Start date of Oct 1st which is normal given the fact that it takes a few months to get license and also finish up boards.

As far as relevance goes I have 2 things to say.
1) Apparently this IS important to the immigrant commuity coz there are people in the same boat as me from the IV community.
2) Some people might be looking to contribute to IV if they get their stimulus refund.

Considering the compelling power of 'numbers', can we publish a thread of compelling statistics showing the economic 'value add' by immigrants of Indian origin in the US? (IIO - Immigrants of Indian Origin)
It would be helpful to parse the current immigration debate and differentiate between ILLEGAL IMMIGR & LEGAL IMMIGR..
How about trying to get some of the following numbers?
- Average household income of IIO?
- % of hi-tech startups founded by IIO?
- % of Venture Capitalist partners who are IIO?
- Number of jobs created by companies founded by IIO?
- Number of companies funded by IIO Venture Capitalists?
- Average wage range of a H1-B worker? (Safely assume as 75K - 110K p.a.)
- $$$ contribution to Social Security and Medicare, as an aggregate across IIO and those awaiting immigration?
- % contribution to Social Security and Medicare, normalized to the total base wages of persons of Indian origin?
- % of US Masters and PhD students who would become IIO if the process were smoother?
- % of Spelling Bee contestants who are of Indian origin, over the last 5 years? (Seriously!!)
- Number of IIO that contribute to state and city government?
If we could contact the Top 10 immigration law firms, we might be able to get the above statistics. Once we have these hard numbers in hand, it is going to be a little easier to get lawmakers' attention.
Further:
- The opportunity cost of time lost due to retrogression does not create a 'win win' outcome for the economy, the applicant and the petitioner
- The actual cost of time and labor spent in following up on retrogression related concerns is time taken away from 'social value add' - like volunteering, fund raising, etc.

Thank you all for the information. I was really banking on 485 provision passing, and me filing for 485 before june. That way I could have avoided the new processing. I read the posts by administrators and was totally disheartened that the provision is not going to pass by feb 15. I guess now we are waiting for CIR.
Can somebody please tell me the process to get the Rap sheet from court and then try to remove the record or things like that. I shall find a good criminal lawyer too. I am in Texas.

I know which country you are talking about. Before you make a statement go there, live for some time, understand and speak.
I can give numerous examples far better than what you are talking. Each individual has their own priorities adn contribute their little bit towards the cause.

My in-laws were with me during 2008 (mother-in-law for 9 months, father in law for 3 months)
In order for me to claim them on my tax returns as dependant, I need to fill w-7 and mail my tax documents to Austin Texas.
My CPA says, i addition to w-7 and passport as attachment, my CPA says that their passporta need to be notarized when they were here.
They already left and there is no way I can notarize from here now.
Indian gazette sign is invalid it seems.
What do I do now? Is it mandatory that we should take notary signature on their passports when they were here.
if anybody has done it differently, pls advise. thanks in advance.

Even in my friends case at Toronto consulate it took 7 weeks. Don't worry and take a trip to Goa, Kerela etc
