Hi,
I have applied my change of status on Jan 25th from F1(Trivalley Univ) to H4. I did recieved my EAC number after 4 weeks. I called USCIS to check the status, They are saying decision is pending. Also they are saying it may take another 3 months.
Is it the same case for other change of status applicants ? or Im the only one having this issue. Is there any way to fasten my process ?
Also for some reason when I check my status online at USCIS website, It says your application cannot be found. I did explained this to USCIS, They say there systems are down. Thye are giving the same explaination from past 3 months. I dont know what going with my file.
Have guys face this kind of issues ? Please share your experience on this.

1 year extensions:
Looks like the question comes from the point of 7th year extension and changeing employer from employer that started labor and new employer. Even if your 7th year extension is not applied or not approved from the company that applied your labor, you can apply for H-1B transfer along with H-1B 7th year extension with the new company giving evidence that your Labor indeed was pending for more than 365 days. You do not need apply and wait until you get 7th year extension with your current employer in order to join a new employer. This way you are making INS rich by giving two fees' to get the H-1B approval for the same period.
7th,8th...year extensions are allowed even with the new employer based on the evidence that your labor or I-140 is pending for more than 365 days before your 6 years H-1B date is reached.
3 year extensions:
Once I-140 is approved you can get three year extensions provided you are subjected to retrogression, ie you cannot apply for I-485 because of retrogression or even though your I-485 is applied, you cannot get approval because your PD is not current. In this situation you can get 3 year extensions with the company through which your I-140 is approved and also from a new company along with H-1B transfer you can request 3 year extension showing the approved I-140 from old company and showing the proof that you are indeed subjected retrogression.
PD portability:
Once the I-140 is approved the alien owns the Priority Date and this date is inter transferable between EB applications (1,2 and 3). Alien owns the PD even if the I-140 is revoked by employer. The only case this PD is not owned by alien is when USCIS revokes the I-140 because it is fraudulent.

Actually, the LUD didn't change on my/wife's I-485. However, there were LUDs on my EAD and AP that was approved a year back in August 2007.

NO you can't deduct perosnal attorney expeses. I work for a large Tax Company and I have checked with our CPA's. You sure can deductible attorney expenes ONLY if they are business related, never personal expenses. If it was the case, people will start deducting their divorce attorney fees and etc...
If GC is only personal based, then for most of us here it should not be tied to employment and bond us to the employer for years, but unfortunately it is not. There is a thin line...

We had seen worst of the GC process:
labor got remanded back to state then send back to DOL again and got approve.
FBI name check stuck for around 2 years,
485 filling during pregnancy,
Fingerprinting notice sent wrong address,
2 RFEs for 485 (one for TB test one to get current employment letter)
and finally retrogression!
I was hopeful when the dates became current that this will be all over soon but logged in today on immigration voice and got the shocking news about visa number for EB are now unavailable. Thought that we were unlucky again.
But then checked the status online on USCIS and there it was following message �
�Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Card production ordered.
On July 2, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.�
Having gone through the worst, I will always support IV and their effort to get justice to all of you. I pray for all of you to get GCs soon.

What is to stop them to refuse all immigration....remember its not a right! make you pack your bags and leave, if they want.

this might be due to pressure by the Big corporates on Gvot.
If USCIS has guts then stop the mis use of L Visas, Busniness VISAs by so called corporates and clean companies. This will lead to greater control over employees and hence greater exploitation of the employees. Overall this curbs freedom of all individuals, all may not realize as people are on different sides.. of the rule....

I look at this like differently, we all in building with people from each country and cateogy packed in one room. Our friends at DOS/CIS get to pick 140k random people from these room (based on 7% country quota and EB category). If they keep SK current that room is always empty and they break the 7% rule. If they follow the 7% rule the olds people in the building (india/china) get a chance to get out.
I agree. The crab analogy does not apply here. The country quota's are supposedly to stop some countries hogging most of visa numbers - but when it has the opposite effect it clearly shows how this quota system and over-flowing methods they are using is so useless.
In my ten years of greencard hassles I have seen many people getting their greencards in a fraction of that time - this after having three grad degrees and 10+ years experience - and if I feel a bit bad about the kid who just got promoted from intern to regular position and got his green card in eight straight months - it does not show my crab mentality but rahter failed country quota policies.
