My employer charged me H1 B transfer and filling fees.
I was told that employer has to pay these fees including lawyer.
Is this correct? If so, can I file a complaint against him in DOL?
Where and how can I file a compaint?
Is is deducted from salary or he has given you receipt for that?
As I understand, employer has to pay, but in consulting business, people are paying from own pocket to get opportunity. I have heard that in recent past, it has become common practice.
Was there any mutual agreement?

My Spouse is working on H1b and his H1B is valid till 2012. His EAD is expiring in aug29 but he did not apply for ead renewel. Can he apply ead now?

Absolutely. The BIGGEST advantage of having an EAD/AP is in situation like this - if you were laid off on H1, you would have to find a new job before traveling out of country. With AOS and EAD/AP, you can move freely (both from a job and travel perspective) and not worry about these things.
The only problem with this is in the situation where your I-485 gets denied. If you are outside US during that time, you cannot re-enter using AP. If you are in US at that moment, you become illegal from the very next day.
The risk is always there whether you are entering using AP or visas like H, B or F etc... In the above example, note that I-485 was denied while he was abroad.
So, while you are abroad and your I-485 is denied, you cannot enter the US using AP. Its as simple as that.

On The alien # inconsistency, I have a question
In some of my documnets, EAD ,AOS receipt notice etc my A# is 'A091XXXXXX'
In my AP etc it does not have a zero. i,e 'A91XXXXXX'.
Is this OK or will it cause problems.

So i had an appointment with my lawyer yesterday and here is the result:
-motion to reopen will not not work quickly as i dont have the denial notice (maybe they never sent one), and waiting for the letter or a response to my request can last years.
-re-filing i485 from the beginning will cause problems again with my 2 different alien numbers and the same problems will repeat themselves.
-attorney inquiry: trying to see the adjustment supervisor in NYC and have him/her fix the problems in my case: the Alien numbers, not receiving interview or denial notices, their computer system fiasco, may again delay everything and it will be a waste of time.
-Writ of Mandamus, in other words suing USCIS will make them review my case and fix the problems and give me an interview date, will be the best and time efficient move. They dont want to lose another case and they will ask to settle before even going to the court. At least that's what happened to my lawyer with her other clients.
I think that nothing can't go worse than now, so i will sue them! i cant lose anything here. or can i? has anyone had a bad experience with this?

"3 years in the US before your apply for your green card" means application date of Labour Certificate or the date on which one can file 485? Because if one graduated(Masters) in Jan 2002 working in US since jan 2002(4 yrs) and has a PD on Jan 2003 will still be under the quota?

Its an advise from lawyer that you need to call the USCIS and get the fax number, if at all they ask you to send additional documents.
This is how it should happen.
a) You call the 1800 number that is on your EAD notice you received after you filed for a renewal.
b) Customer Rep will then judge, if she can expedite your case. If she gets convinced, she will then open SR and give you SR number and number of days to wait for the response. She will also take your personal email id info.
You will receive an email, if USCIS needs additional documents and also fax number to send that data to.
Usually, USCIS doesn't request additional data (recent trend) and they approve it in a day or two.

My wife runs an online travel agency.. There were 7 tickets issued for BA with that fare.
What happened was British Airways Database had problem. Some body from BA put the wrong fare.
As usual airline has the upper hand here.
If u booked this with a travel agency then, there is an agreement between travel agency and airline that if there is anything wrong with the fare by Airline, travel agency has to pay the difference.
If u bought online from BA site, there is somewhere it says airline can revise the price at any time..
Later she had to reissue these tickets for around $1500

Increasing H1 quota helps companies and it also gives opportunity to those who come here. But think about their future when they are here? What next?

There is little hope for GC if H1 quotas are significantly increased but GC quota is not addressed. Who does it help? It helps US companies stay competitive but does it even help the new guy? It will bring down the wages for sure but more people will be living like second class citizens. So does anyone win here except companies? I am pretty much open to competition provided there is a level playing field and those who perform are better rewarded.

I did file for EAD renewal on June 23rd. My PD was current from June 1st. I did call June 30th by POJ method. The IO told me my case taken from the shelf and it was at IO table for review. My case was approved on July 7th. So I believe EAD renewal brought case my case pulled from the USCIS black hole shelf to a table. If your PD date is not current, this will not help. If PD is current and your RD is before the published process date, they will think to approve your case, when they look your file for some thing. Otherwise it will remain in the shelf. That is why the random approvals coming from USCIS. They do not do FIFO rule. Need luck and some kind of triggering.
