Is your husband in H4 now? Was he on H1 before? What is the exact question you need an answer?
GC is for future job and he can do it while on H4 itself. Ask the prospective employer to file for labor. Once it gets approved, let your husband work for that company for two months and get the paystubs. In those two months, get ready to prepare for 140( does not take more than a day to prepare for this one). File 140 in premium and get it approved and then file for h1 extn.
I can say it is possible. You have to work with a good attorney and not on bs attorney. Bad Attorney can really screw up your case as the time is most significant and valuable in your case.

Senior's is there a way to post the current count of ppl intending to attend the rally. I fell if we post an encouraging number, then this might motivate and persuade some indecisive folks to join the rally. Some ppl like to join the herd rather than taking their own decision.

I am new to this forum and am seeking help to find the right choices/answers for questions 14 and 15 in the efile application for renewing EAD. 14) Manner of Last Entry into the U.S. and 15) Current Immigration Status:
I have been using EAD for employment since 2008 and have used AP for travel. The following were the choices for both the questions. I was unsure, what to choose. For people traveling on Advance Parole, I could not figure the manner of last entry nor current immigration status (my 485 is pending).

If you entered last on H1 say H1 else if on AP say "ADVANCE PAROLE (DISTRICT AUTH) "
For current status enter H1 is you are still on H1 regardless of whether you are also on adjustment of status or else say "PAROLEE"

My in-laws (Father-in-law, aged 52 and Mother-in-law, aged 47) got their B1/B2 visa rejected on last week at Chennai consulate (Tamil Interview). They got the denial under Section 214-B (lack strong ties to return back). Following are the exact conversation they had with the consular with the help Tamil translator.
Consular: How many children you have?
In-laws: One daughter who got married and lives in USA and an un-married son who is living with us.
Consular: What do you do for living?
In-laws: We running transport service business.
Consular: How much you make?
In-laws: Rs 20,000- 25,000 per month
Consular: How long your son-in-law and daughter there in USA?
In-laws: My son-in-law is there for 9 years and our daughter is there for 6 years since she got married.
Consular: Did you get their green card? � This is the question, my in�laws got confused and do not what to answer as we did not tell them what to answer. They looked at each other for minute and said
In-laws: They applied for it and waiting for the green card � which is correct
Consular: Oh really? They are there for 9 years, still not got their green card?!!!
That�s was the end of the whole conversation they had. Then consular looked at the computer for some time and issued the denial letter and they said your visa is rejected. My in-laws did not say anything else and returned.
I don�t have any clue why they got rejected. They are running successful business; they have their un-married son and aged parent, who are living with them. We had made every effort to have all needed documents. Since I had told them not answer any thing else until they ask, they did not voluntarily give the extra details. They had bank details, property documents, insurance etc. Consular did not care to ask any of those details.
What could be the basis for this rejection? We are planning to apply again with in 2 months? Is it advisable? What can do differently to get the visa in the next time? Can we all the extra details about the strong ties even when they don�t ask next time?
Any advice/help/information would be greatly appreciated.

She can move to EAD. Fill in I-9 in her new job and she'll be on EAD.
But here's an interesting case, maybe you want to ask your Attorney or someone else can comment on.. If she's laidoff, how does I-9 come in picture. Till she finds the next jobs whats her status ?
If she has not laidoff yet ask her to fill in the I-9 form one day before lay off .Does that work ?

if u have a appointment with kolkata , u can try to send a email to them asking if ur H1 receipt number is in PIMS since it wud help u anticipate/plan for delays. mention that u have a valid appointment with them and give the details
indian consulates being high volume most probably will not react to it, but its worth a try . they may not reply but what if by luck they chk it for u and request an entry to be put in. u never know!
i suggest dont scan ur h1 doc and create a bulky 1-2mb email, which might tempt them to delete it. just type in ur details like h1 receipt #, name, validity, company, i94# etc, few of those imp field on ur notice. keep the subject of ur email something like "enquiry regarding h1b stamping" rather than "PIMS verification" which might outright discourage them from opening it itself. forgive me, im just brain storming for u to see how to make em atleast look at ur case, of course there is not silver bullet for this
going for stamping seems like a leap of faith now :-(
making arrangements for all sorts of things like - pay next months rent, bills, take works' laptop in case u need to sit at home and work for 5 weeks (if client allows), pick only those airline deals that allow u to cancel/postpone...etc etc etc.
i also need to go thro this in coming months. way im looking at it is - as long as i dont lose my job on this issue, its still worth it to go thro all this trouble , cos in the end it'll definitely pay back. I gave up worrying bout getting my PIMS verified, and focusing on convincing my client that there cud be inevitable delays and how to manage that without putting him (and indirectly myself) at risk.

As far as you have a receipt notice (i797) for the i-485 you can file AP and EAD at a later date.

Many of us have been waiting for over 5 years for the damn green card and still no end in sight.
No wonder there's a lot of pent up anger and frustration. :mad:
Want to know how I feel like- I'm standing in a line for over five years through rain, storm hail and wind (i mean layoffs, company shutdowns, M&A, bad economy, etc), and still haven't come to the counter. The wait is endless....imagine how many Americans would tolerate a 5 year+ wait!!
