I knew I will get first hit by you and then my green reputation indicator will turn red, I know I shouldn�t say anything against IV while being on IV.
How about I don�t want to explain. I can only tell that I used to be very active member of DC area, contributed financially and many other ways, attended rally and brought 4 other folks with me. But after the rally, I changed my IV handle and do not promote IV as I used to do pre-rally days. Now I don�t think I am with IVs agenda, or may be I don�t even know what IV�s agenda is. However, I do not want to bring any hurdle in IV�s promotion so MODS please free to delete my comment or let me know I will change it.
All I am asking is a valid reason for your concern. State chapters is Iv strategy. I have never given reds to people, but a lot of people have given me reds for no reason.
Grassroots efforts are effective only if there is active participation.

What was the reason for the 5 year wait for you ? LC stage? I-140 ?

But we do have intentions to work for the sponsoring employer after getting the GC. However before the approval itself, he withdraws I 140, would it have impact on using AC21.
How do you prove that you have intension?. What document do you have? If you have worked for the sponser during GC process (either on H1 or EAD or any other status), then it is easy to prove that you had a intension, as you are already working for him. If your sponser withdraws the 140 with sufficent explantion to USCIS that "though the employee has work authorization (H1B or EAD) the employee is not willing to take the job, therefore we are withdrawing the 140 and job oppertunity is no longer exists to the employee". If he writes that, then it is very genuine reason and it proves that you have no intension to take the job with sponser. In this case you can not prove that you have intension. At that point, your GC journey will come to end.
Dont take what all lawyers are saying. Resarch more materials in USCIS website and other court rulings. Do not end GC journey by just reading in forum or lawyers simple Q&A.

Even if you go back to India( assuming your mother country ) for a year you can then come back after 1 year on H1B again for next 6 years. I know its a pain but always an option. Also you would visit India for about 1 year period in the next 7 years that works fine .

an IV core member to see if the core was aware of this carry over done in 2001/02. They know about it.
All references to EB always quote 140K as the number. So if this carry over from Family Based existed, the number 140K would never be quoted.

if what you guys are saying is correct then, my I94 is expiring in Oct 5 2007 and I have filed I485 with that I94 and my another h1 extension is coming (maybe later august)..
so is this cause of concern..or are they going to issue me any RFE for that..?

Interestingly, I saw soft LUDs with todays date on my pending I-485, pending I-131 and approved I-765 and my wifes pending I-131 , not sure what's happening though :confused: ( as always with USCIS ) . My PD is way ahead (or behind, depends on the way you look at it) of the current cut off date ... March 2005.

Apart from the ability to file I485 during retrogression, the ablilty to make unrestricted changes to jobs using AC21 will make a huge difference. I understand that retrogression issue might take time to heal. However small relief like ability to change jobs using AC21 without restrictions like same job description as per labor; would make a lot of difference to those whose careers are stuck on repeat mode for ages. I am ignorant about what it takes to put this into one of the appropriation bills. But I personally do not mind shelling out money for it if that is what it takes under the current circumstances.

My wife just entered the country 2 weeks back and is looking to file for an H1... I just saw the updates about the number of H1Bs not being filled... Is there still a chance for my wife to apply ??? Can somebody help me find an employer/consultant who is ready to file H1s this year.... ?? I know its a little late.. but I also believe in miracles... :) :)

Your experience must be progressive like you moved 2 or 3 times to higher level position.
The experience should be after your Bachelor Degree and before the current position.
I'm not sure about if you can justify your 5 years experience with a promotion in your current employer.
In the ad the company should look for a person with a master degree or qualify experience.
In the PERM application should specify that the position requires a Master and check yes in the questions:
H.8 Is there an alternate combination of education and experience that is acceptable?
H.19 Does the alien possess the alternate combination of education and experience and indicated in H.8?

I came to US with 8 years experience but only 3.5 post Bachelor Degree.
I change employer this help me to get 5 years experience post BS and my current employer submit my PERM application for a EB2 position.
