I work for company A as an employee and consult for company B.Recently, the consulting gig at company B was over and the client is willing to take me as full time.But company A says they have a contract and hence i cant go work for B.My question is if Company A fails to pay me the minimum wage on LCA and if i complain to DOL can i then go and work for company B or will there be any complications.
I am not even sure why you told them this before joining company B. Just ignore them and move on. They cant pay you, they cant pay for legal action.

Any such campaign must be backed by strong advocacy effort in DC. People helping us in DC should be doing this lobbying work full time for many years and we should be willing to travel to DC on regular basis for meetings. IV has been doing all this for past few years. We can send millions of letters, phone calls and millions of flowers and it will not help unless we have people going and meeting offices in DC on regular basis. (not just a one time meeting). Uncoordinated efforts and efforts without correct messaging will be a waste of time and energy. Advocacy/ lobbying needs lots of time to learn and do it the right way. It requires many years to work on an effort to build strong relationships with offices, other organizations and other stakeholders. It is a complex process that not many people know about.
This is the reason we discourage random phone calls or emails as campaigns unless it is part of a well defined effort that is being done in DC.

My (EJ 2) I-140 got approved in August, 2006. But my contract ends in August 2007. Visa bulletin shows that current priority date in EJ2 is January 2003. It is not moving at all. I am not hoping that it will become current by August 2007.
1) I am assuming I can not get another job because this is my 6th H1-B year (ends in AUgust 2007). Is this true?
2) Can any other institute hire on H1-B based on my approved I-140?
3) If I change my Visa status to J1 or F1 will I lose my Approved I-140 priority date?
4) What is the best thing to do?

If my understanding is correct, you will will NOT be able to take advantage of OPT because MBA is the same as Masters, though the field of study is different.

I graduated with my MS degree from a reputed university, here in the US, in June 2006. I got a job and my employer applied for my H1B immediately and the application was approved before I even started working. But to start working immediately, I had to apply for my OPT as H1B only starts in October. I think I applied for a 9 month OPT but only used a few months as my H1B started in Oct 2006. I had used 3 months of the OPT during my internship between the 1st and 2nd years of the MS program. I have been working on H1 since then (have switched jobs once) and am now keen on pursuing an MBA (full-time) starting 2010.
What I am worried about now is that when I graduate from business school, I would be on F1 visa and looking for jobs again, but would probably not have any OPT left. I am sure I am not the first one to do this, but I don't really understand how the visa situation will work then. When I graduate it will be summer 2012, and I will be on F1. To take up a job right out of school, I will need an OPT or H1B, and H1 wouldn't start till Oct, and I probably won't get any more OPT.
Can someone please provide some guidance here?

I have already applied for a I140 , basically switching another labor, I want to do premium processing to get 3 year H1B extension, my lawyer says it is not possible to premium process the I140 application if you are swaping labor.
Now is it true? or is it onlt true because i have already applied for I140.

Sorry for hijacking this thread. But couldn't figure out ho wto create a new thread.
I have a question regarding using AP for entry in the US.
I am on H1 (did not use ead) but used AP to enter in the US last year in aug(i.e 08). I got I-94 with validity of one year. My question is what happes after I-94 expires. I don't have any plans of going back. Do I need to apply for some thing to get a new I-94?
With the current mess, I don't think i can get the GC before I-94 exppires. (that would be the wildest dream).
I am sure any fellow Ivans are in this situation or were inthis situation.Please advise.

Why pay when it is free.
I pay for my attorney also and I also contribute to IV. Both are not linked. Why people think contributing to IV is waste when they get all their questions answered without lawyer.
it is kind of shameless attitude when you dont want to participate for your own sucess and survival. Common free riders, feel something from your bottom of the heart. $100 is nothing. Atleast contribute at this happy moment of filing 485 and feel proud. Assume you had a party for the dates to become current. Common shell out something. filing 485 is not the end.

How about contribution to IV? for all the questions answered?.

It uses a prefocus flash in low light. I do have some pictures I have to download onto the computer, and I will show you what Im talking about. I will have to look to see if I can find the focus point. It only really did it in shots that were further away. I do have a question however. The lens hoods. Is there any point in keeping them, and if so what do I use them for? I haven't ever really seen anyone use them, and I know that my friends that have these cameras don't use them.

We got RFE recently for medical - for immunization records ... replied the same on time and the doc mentioned that he can't administered certain vaccine as my wife is nursing our new born ... now recently we got a denial on her I-485 application ... which was strange ... my dates are not current and no way near to EB2-I dates ...
Anyway, my lawyer is preparing the MTR and it seems we will end up spending few more hundreds of $ on this never ending journey for GC ...
I did post the same a while back but never saw any response ... seems this case of denial for my wife is one of case and not a pattern ...

Exactly.....mine and my wife's DL renewal (CA) was automatic - we just received it in the mail, we didn't even have to renew it!
Yep .. I renewed mine using internet (after DMV sent me the renewal letter).. I got it easily.
No need to worry .. DMV will send you renewal notice 2 months before ur DL expires.
worst come to worst is if you are not lucky then you have to go to DMV and do another written test :p
