We just received our receipt from USCIS two days ago. Our papers reached on July 13th and our receipt date is Sep 10th. As usual, there is no order in which the process applications. Just hang in there. Good luck to all.

By doing the above, we will permanently be bracketed under Illegal Immigrants category and then what not.
I think, we should have a different approach. The reason, iam here is because i liked the approach we are taking.
We are eductaed and we need to handle things following the protocol which the law makers understand. Pressure tactics will not work and will be seen as nonsense by many.
We need to handle the things right way, even though it takes time. Getting desperate is, when we start loosing.
We need to look at Immigration issue from lawmakers point of view and the American citizens reservations about this whole imigration and their insecurities.
Far more important task for us legal immigrants is, we need to show them that we are not job grabbers but job creaters.
We also need to prove that we do not pose any security threat to them or USA.
Also, we need to rope in Indian government rather than NRI/GC holders in USA.
When Indian companies back home start investing in USA, thatz when things/momentum will build up here.
Looks like we have a long battle to fight. We need to appreciate that we are under a banner.

I do not wish to take away anything from those benefiting from cross chargeability, but only wish to ask this question.
We have laws that impose per country quotas to combat which we have this whole community in the first place. The spirit of these laws was probably to encourage diversity among immigrants, not that I subscribe to these, I myself am stuck in the mud.
Now, supposing somebody's spouse, who is Indian but happened to be born in a country not backlogged, but for all practical purposes this person is Indian, but this couple benefits from this CC law.
Is this defeating the spirit of the law? USCIS/DHS is enforcing the letter of the law while completely defeating the reason this legislation, though archaic, was written in the first place.

Since most members on this forum seem to be Indians, I have a question. How multicultural are Indian cities like Mumbai? Why don't you have millions of immigrants from totally different cultures slamming into your country every year? Here's a clue to the poster above, maybe we'd like our cities to look like American ones. And the sad fact is that London has ceased to be a British city anymore; it is one, like many here in the US, where the British people have fled to smaller communities to live in something that looks like Britian to them.

cant it be from ppl who have left the company!..both my managers have quit the firm ..and started their own firms..
and no one who works there was my manager...the HR is acting nuts..

Hello, I am an Indian working in US for 2 years, I am on H1B visa now. before that I did my Masters in US. I did not applied for Green card yet. Actually I am going to marry a Russian girl in 6 months time. I want to know if I can apply for Green card under her name after our marriage. (can I do that?) Because I heard that getting Green cards for Indians takes lot of time. If I apply for Green card after she comes to US, then do we both get green card soon? I am not familiar with the green card rules yet. Any advice will be appreciated. Thanks a lot. :)
If u r serious to get the GC, don't even imagine to apply urself as Indian...u will almost never going to get it unless u r ok to wait for 10-15 years. Its no brainer to understand that if u apply through ur wife, u will not only get the GC but will get sooner.

Reeves & Associates met with Congressman Howard L. Berman last week to discuss immigration reform, including earned legalization of undocumented aliens and the DREAM Act. Attorneys Robert L. Reeves and Elsie Arias, along with other prominent immigration lawyers and community activists, responded to the Congressman's legislative update and advised him of specific issues concerning the immigrant community.
Congressman Berman, a Democratic member of the U.S. House of Representatives since 1983, represents the 28th District of California which largely covers northern San Fernando Valley. He is a senior member of the Judiciary Committee's Subcommittee on Immigration, Citizenship, Refugees, Border Security, and International Law.
In the private lunch meeting, Congressman Berman said that the committee would use S. 2611 - "Comprehensive Immigration Reform Act of 2006" as a starting point to draft legislation that would address the U.S.'s complex immigration problems. He reported that the subcommittee intends to mark up the bill in March, and forward its version to the Senate by late May. He also stated that House Speaker Nancy Pelosi wanted a compromise bill forged between the Senate and the House by July or August, for a final vote by September of this year.
Congressman Berman averred that bipartisan support in the House of Representatives is critical, as Republicans in the House largely oppose proposals for legalization.
Congressman Berman confirmed that a comprehensive immigration reform bill would contain four main components: One, legalize the estimated 12 million undocumented aliens in the U.S. with an eventual path to citizenship. Requirements would include employment sponsorship, background checks, English fluency, and paying back taxes.
Another possible requirement may involve the alien returning to his or her home country to process residency documents, but various individuals at the meeting advised the Congressman that such a "touch-back" requirement would present logistical and economic hardships to qualified applicants.
A second component of an immigration reform bill would entail a temporary guest worker program to meet continuing and immediate employer needs. A third component would increase immigrant visas to reduce the backlog for family-based categories and reunite families more quickly. Addressing Republicans' concerns, a fourth component of the bill would bolster border security and increase enforcement of laws prohibiting unauthorized employment.
Congressman Berman also mentioned that the subcommittee would address the need for agricultural employment visas ("AgJobs"), and an increase in H-1B and H-2A/H-2B visas. Additionally, he confirmed that the DREAM Act would be reintroduced to Congress. If enacted, the DREAM Act ("Development, Relief and Education for Alien Minors" Act) will allow undocumented children who entered the U.S under the age of 16 to obtain conditional permanent residency if they have lived in the U.S. for at least five years, and have either been admitted to a college in the U.S. or obtained a high school diploma or general education development certificate. The alien's conditional status would be lifted after demonstrating that he or she has earned a college degree or completed at least two years towards a bachelor degree or higher in the U.S. Congressman Berman indicated that all of these issues would be encompassed in a single, comprehensive immigration reform bill rather than enacted as stand-alone bills so as to cultivate broad support from discrete groups including employers, labor, and immigrant rights activists.
Following his update, Congressman Berman elicited comments and questions from the small group of immigration attorneys and community leaders. Attorney Robert Reeves expressed concerns about the fee increase proposed recently by the Department of Homeland Security (DHS), which would double or triple the current filing fees and represent a financial bulwark to low-income immigrants. He also requested Congress to consider including foreign nationals presently in removal proceedings, or who have been deported but remain in the U.S., in an earned legalization program.
Attorney Elsie Arias indicated that Congress should also address the extensive visa backlogs in the employment-based immigration categories, particularly the delays in obtaining immigrant visas for registered nurses and other critical healthcare workers.

It was a great feeling to be part of this rally.
I somehow feel ,may be in future,a common dress code could make a huge visual impact- like everybody wearing same T-shirts with appropriate words/slogans.
When 300-400 people wear similar T-shirts,that itself catches public eye.
Need time and money for all that,but a well done event in the end.
Although it was a decent sized crowd,I am sure there were many around San Jose who didnt make it to this rally.With so many big corporate houses around,I am sure there would be at least around 2000+ people around here,who are affected by July Visa Bulletin. I guess people should not just sit at home and browse forums,but try and actively participate in such events.
Guess something more needs to be done to attract and lure people to these events.

GM which is one of the biggest recepient of bail out money is going to export chinese cars to US market!! I am perfectly fine with that. Kudos to chinese car manufacterors. Now here is the problem...
1) companies which recieved TARP fund cannot hire H1bs!!!! but now it seems they can go and get work done elsewhere and then ship the product here??
2) Which is better for the economy?
a- skilled workers moving to the US and reviving the manufactoring base and this might involve reducing wages of course.
or
b- prevent skilled worker migration and instead import products from outside which will be effective on the short run due to the present capacity for borrowing heavily??
Consider these facts while answering;
but how long can you borrow?? dont you need to produce something here, in the US?? skilled worker reduces the wages? isnt that good to be competitive??

I am not an expert at immigration laws but a similiar situation happened with my friend. Does not matter if you are fired or laid off. Even if the company sends the letter to USCIS to withdraw the H1 sponsorship your friend is still allowed to stay in USA till his H1 expires. He can work only for the company that transfers his H1, but he can stay till the H1 expires. The law only says that if H1 is transferred within 30 days it will be transferred with no or minimum questions asked. Greater than 30 days; there is no guarantee that H1 will be transferred. However my attorney has done cases even upto 4 to 5 months delay and the H1 has been transferred without any questions or RFI.
* Once your H1 is cancelled, you are out of status, and are accruing out -of-status time; which if it exceeds 6 months, can make getting a greencard very difficult.
* there is no law that says the H1 can be transferred within 30 days with no questions asked. Its all upto the discretion of the adjudicating officer.
* A successful H1 status transfer with 5 months out of status is VERY rare. In almost all such cases USCIS will approve the petition, but not the change of status, and the employee has to leave the US ASAP and re-enter.

If you look at what Obama said on Airforce One the other day and the comments now, it is clear that he is not really committed in getting the CIR done this year. Just to pacify the Hispanic community we will probably have some kind of a start and thats about it.
That might be true. But there are many pots simmering in the background, and because of the events of the last few weeks incuding Arizona's new law, there has been a pressure building on the congress and the president.
We can help to continue to build this pressure by calling our senators and forcing them to take up the debate.
This is the right time, if we do not do anything now, we will have to wait till 2012 or 2013.
Please call our senators now.
