As they said it is good to file for an extension while in USA. Trying to convince the POE is very risky after coming back and the extra expense and can have their visa canceled depending on the Officer and his mood.
Other wise as a general thumb rule its 6 months in a year and that too not every year consistently.
If they stay back after an extension and try to come back after another year or so it is likely they may be denied entry. With USA its best to take the worst case scenario and keep a good record.
ofcourse if you dont want your inlaws to come back and then just have them overstay :)

You are right, I confirmed this with IRS. Who can be more accurate than IRS :). So yes you can register S-Corp on EAD or even if you are on H1B.

Then something else has to be done. 1st option, you can have your petitionor employer write something promising that you'll be paid that much at the time your 485 being approved. But it will come back to you when you file 485, and you'll have to show you are paid that much at that time to get 485 approved. 2nd option, ask to waive the wage requirment, aguing yours is different from others in the same category. But this has rare chance of success. Any way, the most important thing is find a capable atterney.

I was wondering if it is possible to have a' Recent Blog entries' area on Home page just like 'Recent Forum Posts'
If that is possible then we can push all non-immigration related stuff into blog area and since they also show up on main page those entries would also get same attention from interested folks like threads do.(Hopefully)It would also take care of all the folks that keep getting offended by non-immi threads ( folks who kind of keep threatening to leave IV because of this).
I never go to check the Blogs and I don't know if there are people like me there.But I would have surely gone to check those blogs (if title was catchy)if it showed up on main page. In fact I think first time I went to the blogs area was when you posted that cricket thing.
Since Admin2 mentioned using Blog area in the post above I thought of adding my suggestion here instead of opening another thread.
Of course this is just a suggestion.If it is too much work/if it is not possible then please ignore it.

I am sending this letter not only to President elect Obama but my local media as well. I am going to mass mail our voice until it reaches enough ears to open them & cause action. I have had enough of this uncertain ridiculous wait. While I still have some strength in my bones, I am going to give this all I got. YES IV CAN!!

Hi,
Long time reader of the forum, first post. My mother is very ill and she is in India and I need to go to India soon. Here is the situation, My wife is on H1b and I am on H4. We have not left the country so we don't have visa stamps in our passports. We both have the I-797 approval notices. Mine was f1 to h4 after we got married.
Now can I go to Canada and get my H4 stamping done instead of India, I feel there is a better chance in Canada than India. Does my wife (principal applicant) needs to have her H1 stamped on her passport. If I need to do it in India, what documents do I need, do I have to go the consulate or I can come to USA and at the Port of entry they will stamp.
Please advise
If your wife * H1b ) holder has job or project and client letter and not on bench in last sixth month and have W2s for past years then go for India that will save cost and time. You may qualify for emergency appointment in India. Appointment in india doesn't take more than 2 weeks these days.

Be careful about working on AP. It tends to trigger NOID on I-485 during I-485 approval. Search for LCA violation posts and you might get some idea.

AP or Visa is used to enter inside the country and that has nothing to do with work authorization. I have used AP several times and contnued with H1B and even got H1B extension with I-94. The only confusing thing is going out of the country while H1B transfer is pending and entering on AP to continue on H1B. Can you educate me? How does this violate LCA and trigger NOID?

I asked the company where I am taking the new offer to give me the occupation codes. The HR dept is not aware of this. Are these codes assigned by Dept of Labor when they created these posts Or we have ot derive these codes based on the job title and description from the site BhartPremi gave ?

In Texas, H4 pays instate tution. Another option here is, if someone has stayed in texas for more than a year and has been a dependendednt for tax purposes is entitles for instate tution.
School officials want to go simplest safest route, so one must check rules. Talk to state office, governement officials have better understanding of these rules than school. Also school wants to get tution out of your pocket.

We had seen worst of the GC process:
labor got remanded back to state then send back to DOL again and got approve.
FBI name check stuck for around 2 years,
485 filling during pregnancy,
Fingerprinting notice sent wrong address,
2 RFEs for 485 (one for TB test one to get current employment letter)
and finally retrogression!
I was hopeful when the dates became current that this will be all over soon but logged in today on immigration voice and got the shocking news about visa number for EB are now unavailable. Thought that we were unlucky again.
But then checked the status online on USCIS and there it was following message �
�Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Card production ordered.
On July 2, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. Good you bought it up. There are number of people who appear to be getting the I 140 RFE's.
BTW, Any one with Future employment got RFE. I got an RFE but still dont what actually has been asked. got to wait and see. How much does it usually take to recieve the RFE mail since it is updated on the website?

sorry to hear about your mother's health situation. I am just giving you advise from my heart. Given the situation, the last thing right now you should worry is the immigration crap. you don't need any visa to go back to your home country. Forget about this visa business for time being and take the first flight to see your mother. that is the most important thing in world. Your h1/h4/gc and all that you can do once again as you got your whole life for it.

I think soon the time will come when legal immigrant on the path of becoming "permanent residents" (AOS) will stand side-by-side with the citizens and permanent residents in opposing temporary work-permits or non-permanent work visa (H1B) on which they themselves came; to save the job in US.
We might loose our local job to a person just like us who is here on a non-immigrant dual-intent work visa, sponsered by a IT out-sourcing firm (just as our past employers, or even current employers i might say). The new guy will first learn the trick of trade and then act as "Onsite Coordinator" and get the same stuff done from remote site...
