There are some concerns made in this thread and IV can look into that. Every small or big effort requires spending resources and political capital against it. At this time our focus has been CIR and making sure all our favorable provisions are there and then go through every next stage in the bill. There will be work even after the bill passes to ensure we all get our GCs soon without adminstrative delays. Our hands are also tied due to lack of sufficient resources ( you have seen how hard it is to run funding drives on the forum every month so that we can continue our efforts) . Help us kill the big retrogression monster first.

This will only create further problems. The word 'immigraion' is a taboo in this country. Whether legal or illegal , does not matter. Anything done in public is sure to generate anger. We can only go the IV way.

hi very useful thread, my wife who was working back home cannot work here as she is on h4 (no EAD yet).
We too started cribbing about it, and few months passed, sitting at home just makes one go mad, so decided we wuld go to school and may be try in h1 lottery this year....
So i would suggest not wasting the time for all those h4 ppl and try to make some meaningful use by either going to school or trying to find out who can sponsor a work permit etc...
I am all in for this, and am ready to support this initiative....
But we first need to clearly lay down what is our proposal,
a) Are we talkin about allowing H4 people to work (like how L2 can work)...
b) Are we talkin about providing SSN for h4 people so that they can get stimulus benefit...
With new obama govt i am sure if we collect together and lay our proposal , they may atleast think about it....

Its a great idea to create a job posting section on the website. I am sure over the period of time, we will be able to attract the recruiters on to this website along side dice and other job related sites. We have a good number of skilled folks on this site.. Hopefully this will provide is potential add revenue as well... may be I am streatching it far.. but something to think about.

I checked with my attorney yesterday...Now he asks me not to work till I get the approval. 2days back status of my H1B premium processing has been moved to 'Request for evidence'..which is regarding some extra fee as a result of some new rule..He says that this was the reason why he wants me not to work until it is resolved....
I am not sure for what reason, but your suggestion helped me a lot. I have another question, if incase my H1B gets denied, do I have any other option? will I be able to get my F1 status back??
I am glad he advised you to stop working, though triggering a RFE for extra fees shouldn't have led him to ask you to stop working, unless RFE contains other information he is not disclosing.
I don't think your H1 would be denied because the RFE only asked for additional fee (assuming no other information is requested). Incase your H1 is denied, you can try and get another job and have the new employer file a H1 for you again as soon as possible because you will start accruing illegal stay from the day your H1 is denied. You won't get back your F-1 status automatically. You will have to get a new I-20 and "probably" re-enter the country after getting a new F-1 visa stamp.

According to consulate this reason will result in a loss of Job in America. Never give this reason. Sure they will reject visa.
The only reason which they cannot ignore is Tourism purpose.
Just ask your parents to say that they wanted to see USA. We are planning to Go from Such and Such a date and seeing places ...Give names of places.
Since my son/daughter is there its an oppurtunity to see them also. If my son/Daughter was not there then also we would have gone through some Travel Agency to visit america as a tourist.
If travel date is quite far let they say the they want to make sure Visa is approved so they have come to consulate for visa. Once we get visa they can plan trip accordingly.

Did you send any experience letters to prove that you had minimum of Five years experience before joining this employer?
Also, did you regulary check status in the USCIS website? If you are sure that they did not send RFE before the denial then it may be a good sign.
I opened MTR, Appeal etc. Nothing worked in my case because the reason was correct in the second time denial.
MTR normally take few months. It may take few days to send the approval, if your attorney clearly proves that the denial was USCIS error or silly mistake from his part.
Just relax and wait. If possible, change your login name...

There is a lot of movement in the Hispanic community to get the immigration bill on the floor. The Senate has come out with the draft. Now the President seems to be walking towards the goal.

As per Feb 20, 1992 memo, the full-time work is generally considered to be 35-40 hours per week or whatever is appropriate for the occupation. For example, that air traffic controllers work 30 hours a week because of the stress. Then, in that case 30 hours would be "full time".

two years is the generally accepted threshold for WOM. Also, the US attorney's office handles immigration cases, not the DA's office.
If your visa numbers arent current, the US attorney will usually move to dismiss however it really depends on the relief you ask for.
