My company has also decided to file my GC..and I have similar issue as Kowligi.
I had complete almost 5 years before joning my current company, but felt short of 15 days for the 5 years of experience outside your current company.
Should I talk to my Manager for the future position thing or go with EB2 filling taking current position?

I too got an RFE (my I-140 was filed under EB-2 India on 7/6) on 01/24. We replied on 2/4 and we got an LUD that they recd our response. Still no news on anything. What I heard is that when they issue a RFE and when they receive it, they check whether your date of filing (RD) is within the Oricessing Times that they publish monthly and if not, they keep it on hold till your dates are within the processing date, which for I-140 EB2 is May 09 per the latest Feb bulletin for NSC...
Anyone has any views on this? Please share anything which you may know. It's been a really long wait for me to get past this I-140 (started this GC journey in 2003 and still waiting, though I know there are many people like me...)

Most of the 140 RFEs are related to ability to pay or education or references to your previous employment. Since you mentioned ability to pay wont be any issue, it may be related to your educational requirements for the position or prior experience.

If you are using your EAD, then there is nothing you have to do. If you are on H1, then your employer will have to file a new LCA indicating the location change and probably an amendment to your current H1 indicating the same (I am not sure about the amendment)...You can check with a lawyer...

did the statuses of your 485s for either of you guys indicate anything other than Pending?
Just get ur attorney to file MTRs and u shud be fine.
I know its unwanted tension and expenses. But file the MTR and relax.

Unfortunately it is act that is abused like the anti-dowry act in India so USCIS will be suspicious and thats why you need a lawtyer to handle this.
There is no mention of "Violence" in the orig post. such suggesions would waste OP's precious time and resources, rather than helping her.

rather than asking what position would qualify you for EB2, it would be better to reveal the position that is available or you are applying to or the position you are being offered by your company and how much different it is from your current position.May be then, somebody will be able to advise you regarding if it works out or not. all the best

The provision for some high-skills reform was thwarted by Sensenbrenner in the House and Sessions in the Senate and those 2 guys kept it out of the bill because this effort was a last minute effort out-of-order that needs unanimous consent. A single legislator can block it. That's what happened - Sensenbrenner and Sessions.
VP may have cast a tie breaker vote but that vote was on the whole bill, not on this provision.
Are we talking about the 2005 debacle? It was Sensenbrenner more than Sessions as the Senate did pass the amendment to recapture the visa numbers. Sensenbrenner successfully blocked it using the "majority of the majority" thumb rule that Hastert applied to bring any legislation to the house floor for voting.
Had it been on the House floor, it may have passed narrowly. But, it was the major reason for IV to be formed. So, in a way, we have a forum which we would not have if not for that episode.

Take these things as they come. Dont live in future pain.
There a thousand reasons for triggering RFE, another thousand for trigger a NOID (notice of intent to deny).
On the other hand, there are nearly a thousand waivers for getting out of those problems should they arise.
Trying to predict all possibilities and also trying to prepare for those occurences will drive you mad. You will think yourself to death before your 485 is approved. There are people who have gotten GC even after being convicted of drunk driving. Yes, its difficult for them and the difficulties and amount of delays/pain varies from case to case.
And no, I am not saying that "Attend the rally, forget about your pending 485". I believe that at the end of the day, surrogate enthusiams about rally or any other such activity is not going to go very far. My enthusiams and desire for your presence in any action item doesnt translate into your indegenious desire to be active. You can only inspire so much.
Nonetheless, dont kill yourself over these possibilities. Because there are million possible permutations and combinations of things that could happen and studying the CFRs and INA to death wont make any difference. After spending days and days in worrying, you will still be there where you are now in your angst regarding immigration.
When we told people that getting receipt notices will not end their angst, it was hard to believe, but now, people who are getting receipt notices are worried about the next thing. At the end of the day, guys, its just frigging paperwork. Even green card, while being physically a card, is just paperwork. Its not your arm and leg. Its not worth your health - physical or mental. So try to also live, while you wait for your 485 to process and dont hold your breath coz its going to be a long time and you dont want to suffocate yourself.

Dem's made huge promises during elections and could not pull anything major together in past 1 year. For a common american, its a failure. The change that they were talking about are all up in the air. Do not go just by words as there is a history of flip flopping on words... look at the records. Remember! Sen. declared that he would not run for the highest office in next couple years, when asked by media after the election to Senate. You know now what happened to those words.

All of them are unpaid and if I claim as volunteer, do u think USCIS will buy it, especially for the first one for other two it may be okay ?
It really boils down to what was the work he was doing. If he was working for some charity , community or something for greater good (not for profit), he may pull it off but if it is some thing like working for a company , university (Non-Acedemic positions) or something for profit, I don't think it will work..
there is no grey area regarding this..even if it there..just forget it..as long as you are not paid, you don't owe taxes, that is what INS/IRS will look for, rest everything is Volunteer.
