As Rodney King famously remarked, "Why can't we all get along?" As Democrats and Republicans in Congress have spent the past year beating each other up regarding the health care bill, do we want the same thing to happen with immigration this year? At the moment, President Obama cannot even find two Republican senators out of 40 to support Comprehensive Immigration Reform. Maybe i am the one not understanding, but after my I-140 is approved and i get a copy of the I-140 and the approved labor and also the 3 year extension and suppose i get the extension stamped on my passport, can i then transfer my H1 to another company, even though i have completed my 6 years and i only got a 3 year extension because of my pending green card?
from the posts i think you guys have answered to my other questions of using the priority date of my old I-140.

Write a strong Invitation letter saying that there is a chance of you going back to India for Good and its your wish to show your parents USA Once.
And also let your parents say the same reason at consulate.
Also take a letter from you employer saying that you are planning to get your parents here for Tourism purpose only.
Ask them to show all properties bank account and your property in India and let they say when my children are planning to come back what we will do there. I,e there main intention is tourism and spend time with there son/daughter. If they have grandson/daughter also they can specify. (for questions like what is the guarantee that they will come back)
Some times consulate gives high value for such letters and answers.
Try till you succeed. Just keep encouraging your parents. I know this is frustrating but no other go.

any sensitive strategy information. The best way to do this is to talk to your local state chapter leaders over phone or such. Many of you do not want to join the state chapters but want information on what IV is doing. :)
One of the main reasons to strengthen the state chapters was also to enable frequent passage of information/developments etc from the IV core to the chapters. This is what we do at the chapter meetup(s). Also developments change often that frequent updates cannot be given or become obsolete.
I have talked to the IV leadership and I am assured that they are working diligently behind the scenes on multiple possibilities. Success will be ours. :)

It is ironic for a person with user ID BECsufferer is saying others should not express there concerns.
There is no irony, he is very right. The only injustice with Indians and Chinese is with the comparison to other countries. After all America belongs to its citizens, they come first before the frigging H1b body shops and outsourcing pimps. Personally, am just grateful to have been a student of American economy and Technology consulting (although there is lot one can do to improve there).

I had a lengthy conversation with the Residency Classification Specialist at ASU about this. I don't know whether the same thing applies for dependent applicants:
In order to qualify for residency as an independent student, all 3 of the following guidelines must be met: 1) 12 months continuous physical presence in the State of Arizona, 2) 12 months intent to establish domicile here (documented as a change of driver's license, vehicle registration, banking, etc.), and 3) 2 years financial independence/self-support. Earnings of $8,000 plus tuition expenses for 2 tax years must be established to be considered self-supporting and not being claimed on parents' or any one else's taxes to be considered independent. More detailed guidelines are available on the web at http://www.asu.edu/registrar/residency .
The requirements for residency status are established by the Arizona Board of Regents and are reflective of state law. State law says that an individual is not entitled to classification as an Arizona resident for tuition purposes until permanently domiciled in this state for 12 continuous months. In order to establish a permanent domicile one must couple physical presence with objective evidence of intent. Again, this must be shown for 12 continuous months.
Some visa statuses are not eligible to establish residency for tuition purposes. This is due to the nature and definition of certain visa classifications. For example, holders of F-1 student visas by definition are here temporarily for the express purpose of school and not to establish a permanent home (the intent requirement).
The H visa is another example of a temporary visa. Holders of H visas are individuals who are here in the U.S. on a temporary basis for work purposes and who have residence in a foreign country which they have no intention of abandoning. While federal law permits the H visa holder to have "dual intent" for the very limited purpose of applying for permanent status, in order to realize the benefit of the "dual intent" doctrine, that individual must file the I-485 form.
In short, one must be able to establish a permanent domicile in the U.S. before being able to establish a permanent domicile in Arizona. For a non-U.S.-citizen, filing the I-485 begins the intent to establish a permanent domicile. This would need to be in place for 12 months to be entitled to in-state tuition classification in Arizona.

Not sure if my response is gonna help. You said 80% that she has to go. But I bet you it is 100% that you have to apply 485 now and not take a chance. You will be gambling if you don't. I will postpone the trip to get things done now. Not a time or age to play with this short application window.

Just wanted to update the guys on this thread:
Received CPO email for EAD's today. So it took them only 3 weeks since I responded to the RFE...not bad at all.
The status on the UCSIS website says that an RFE has been issued on our 765 applications for the spouse & I. Still have not received the physical notice, so not sure about the reason for RFE.
Are there others out there in a similar situation? Curious what the reason could be since it didn't seem to matter the first time around! Also, not sure if there is a typical turn around time after one responds to the RFE for EAD approval? My wife's EAD expires Oct04, so it looks like she might have a break in employment.

True, I know that is for visas. For H1 application i am not sure, also here the latest action is denial of h1 transfer not original h1 application.
Anyway that's what i am trying to find out. Is my old application still valid and can i transfer to some other company.
Please, correct me if I am wrong here. My understanding on this is uscis follows 'Last Action Taken' rule which invalidates the previous visas issued.

Looks like Ms. Murthy's clients requested her to confuse their employees. She is only talking about a very narrow scenario. It applies to people whose priority date is current and are looking for new jobs. No need to panic.
