I realized this morning that my passport got expired on 4/4/2007. Can I renew it at any Indian embassy in U.S after the expiration date?
I have valid 1-94. Any advice or help would be appreciated.

Yes, you can. You can mail the documents to any consulate. But If it is more than one year of expiration, then you have to go in person to get the renewed passport.

This is confusing me because my I140 and I485 were filed in California and my I140 is approved. So why are they suddenly transferring I485 to NE?

Guess what happened, now? I just lost my current job yesterday. (I'm EB3-ROW and my PD is may 2006, I-140 approved last year and i485 is pending more than 15 months). I'm just in a fix now. My wife is working on her EAD she she is pregnant and have to stop working soon. I also have my EAD but renewed my H1b last month as my i-485 is pending.
AS i lost my job now....what is my status? I'm scared guys. within how many days do i have to find a job? Is there any time limit or i can take as long as i want. My employer told me that is id going to continue my application. Does he have any control about my application? What's the worst he can do now? What should i do now?

Does USCIS issue multiple RFEs on I-485 simultaneously or consecutively? The reason I ask is because both myself and my wife recently got RFEs. Myself because the Doctor forgot to fill in the Tuberculosis details and for my wife about her birth certificate. We have responded to both and the responses are exactly what they requested in the RFE.
Should we now relax and just wait for the PD to be come current and get our GC or is there a possibility of getting more RFEs? When there are multiple issues in an application would USCIS raise all of them simultaneously or wait for the response for the first one before raising the second one? Any one have any experience in this regard?
Its PIT ( Point in time) , so they see u are missing something they issue an RFE, they get the evidence and go to next step... the story goes on

I am currently in US on L-1B that is expiring on June 15th 2010. I am planning to travel to India and return to US around May 10th. That will be around a month from the date my visa expires. My question is will I face any problems at the port of entry upon my return? I am needed on an assignment in US until Aug 2011 and so my employer is planning to file an extension as soon as I return to US.

addsf345, you rightly said there are no free lunches. So, why don't you call the IRS or the "Fresno Tax Authority" (if something like that exists) and find out ? If you did not live in Fresno, I can't imagine why you would get a tax refund.

I dont mean to scare you or give you any wrong information but according to my interpretation of Yates Memo your I 140 right now stands denied with an MTR pending and so I am saying talk to an experienced attorney before you invoke AC 21. Your I 140 status never affects your H1B hey are independent. But I am not so sure about your I 485.
I got my I140 approved but not the Amendment(Amendment was filed for merger that happens last year). My question is, does the denial of Amendment negates my original I140 approval?. If it is so my H1, 485, EAD should have been revoked?.

My younger brother has a visa interview next week at Delhi consulate.
Some facts
-I am on h1b (came as a student in 2002)
-My Parents are currently in US. This is 3rd trip to US.
-My Sister and Brother in law are GC holder alongwith 1 GC holder kid and 1 USC kid.
-We are expecting :)
I am not sure how these facts will be seen @ visa interview by the officer as he can easily think that my younger brother is a potential immigrant.
There is one big supporting fact and that is my brother has an admit to IIM which he has to join in Jun last week. He just wants to come here for 1 month.
Anyone out here has any suggestion which might help for stamping? DS 156 I have clearly disclosed about my Sister having a GC and parents being here can be asked in interview.
Any suggestion will be highly appreciated.

There's no need to try and shove any information unless asked, and in the process appear too eager to prove intent to return. Just ask your brother to keep all his documentation in order, and that includes admission letter & fee payment receipts etc to show if asked. He can definitely mention purpose of visit as a short, relaxing vacation before coming back to slog on his MBA like crazyghoda mentioned. Just ask him to stay relaxed and truthfully respond to questions with mostly to-the-point answers.
From my brother's experience, your papers are more important. He should have your employment letter, H1 I-797, and your I-134 affidavit of support form with supporting documentation, and optionally a letter from you inviting him & stating purpose of visit. They already know from your I134 if you have sponsored your parents. In our case, they quickly checked upon me and granted him a visa.
Having said that, standard disclaimer of "Your mileage may vary" applies. ;) My best wishes for your brothers interview. :cool:

Let me be first one here to speak on behalf of that unborn child!
First, even in best of the cases, travel so late in term is not preferred!
Secondly, primary reason behind these trips generally is to get support from parents, luckily(just from support POV) your husband is at home, he can help around, you are living in best country to have kid in, At worst, get a temperory insurance if you don't have one currently..
Another point to see is, lets say baby is born in India, Since you've applied for GC here, and chances are you will get in next couple of yrs. so if you've made your mind to settle here, won't it be in the best interests of your child to be natural born native??
And most importantly, since both of you are on EAD (or on h1 without recent paystubs which is even worse) you are inviting world of headache should you end up delivering in India..
So all in all.. once again.. if you want to go.. go sooner and come back sooner.. to minimize your chances of delivery in India..

Did your previous employer had group insurance? If yes...then you can keep that plan by paying out of your pocket. That's the best bet to get maternity insurance.

My wild guess is if you apply thru attorney and word it properly any trivial reason also gets you extension.

We had filed extension with the reason stating my parents would like to visit other parts of US (Tourism), we did not hire attorney for the work.
In the rejection, I think they stated 6 months was more than enough to visit different parts of US and spend time with children.
In my opinion, the approval rate for extension is high, but the risk we take is not worth it.
Even if the approval rate is 80%, if you happened to be in the unlucky 20%, the consequences are very heavy. On the other hand if our parents decide to go back to home country for a short duration and return, then the
Disadvantages are

2. Travel cost
3. Hear the long boring song from immigration agent, while re entry.
Advantages are
1. Take care of their Medical checkup
2. Take care of properties, pension, bills etc
