My I-824 which I filed to get a copy of I-140 has been denied.
This is FYI to all who are trying to get a copy of their I-140.
DO NOT APPLY I-824 TO GET A COPY OF I-140, APPLY THROUGH FOIA.
I GOT MY COPY OF I-140 APPROVAL THROUGH FOIA.:D
The timing can not be any better as 180 days is looming. :D

Guys,
I have been watching you guys and I appreciate your efforts, enthusiam and hope to get permanent residency. I have also talked to few guys about this and to my surprise most of them do not want fight for permanent residency. They just "ignore" the happenings at INS.
I want to return with my social security dollars (at least $50k nice enough in India for a good down payment)
Also, Is there a way a person can file a lawsuit against the government to get the social security money back. I'm convinced that even if I wait here for another 5 years I would not be able to get GC. Unless the Congress does not remove the "racism" of "per country limit" it is unrealistic that the problem would be solved by any bill. In my opinion, the government like any other country has "double standards". They would tell great things about immigration but in reality would not do anything.
The real opinion about immigrants:
1. Immigrants drive down the wages.
2. They are the source of cheap labor.
3. Even if they are abused they would not fight back because they have come here to pursue American Dream.
4. Even if a few guys return they are plenty who would like to come here. After landing here, such people face harsh realities and are ashamed of their decision. Thinking of embarassment, they struggle for years to make a living.
I think the effect of 300,000 Immigrants is not felt, since it is a very small group to influence an election.
The real influence is social security dollars. If all of them ask for their social security dollars it would make a significant impact. Baby boomers will retire the next year making the problem worse for government. It is the best opportunity to ask for tax dollars or else .... Green Card would be a "compromise" in exchange for stopping people to ask for their money.
Another good option was to fight our case with the help of Peter Schey. I don't know how much time it would take, but it appears to me as a worthwhile option.
Playing the civil rights card is another option. Contacting civil rights activists may influence some congressman.
Lobbying would be difficult after Abramovich case because the government would be tightening its grip on such affairs.

To me this looks to be one more case of EB2 fraud. Desi consultant plus trying to prove INdian MSc is equivalent to US graduate degree. At least USCIS has woken up now.
To me all F1 Eb2s are fraud who came on non-immigrant intent visa and later filed for GC.

So far i have not come across any non-south asian person being stuck in the Additional/Mandatory Administrative Processing (AAP)/security clearance/background check. Is there a reason for this "fondness" with the South Asians or have the consulates unilaterally decided to cleanse the US of south asian H1B holders (remember many people end up losing their jobs and belongings due to extra-ordinarily long delays). Since when did India fall in the same group as state sponsors of terrorism or in the same group as Iran/Iraq/Syria etc. where people go through extensive checks before getting US visas. At the time of visa interviews, consulates/DOS like to abuse our intelligence by stating that our cases will be resolved in 2-3 weeks and only some cases may get "delayed longer". With this open ended "longer delay" provided in the Immigration Law, there is no reason to think that this provision will not be abused and that people will not suffer unjustly. Even people with multiple H1B stampings over the years (some as recent as last year) somehow become ineligible for a fresh visa stamp and are referred to security clearances. Who is at fault here, the previous visa officer at a different consulate or the current consulate? Many cases have come up where people who had been stuck last year or before have gotten stuck again (for as simple as common name...what in the Gods name is the problem with these guys). With these policies law-abiding high skilled workforce is being forced to never come out of the USA (some may prefer to be illegal that to willingly go out to maintain status and get targeted by the consulates). Imagine if a guy has to get married, has to meet his new born baby, has to see his ailing parents, or has to attend god-forbid a funeral in his family and he knows he has to get stamped before he returns after fulfilling his social responsibilities. How will he feel after reading all these horror stories. So much for US govts goals of protecting family values in the US society.

How long after getting the greencard can you file for citizenship? Then how long to get the actual citizenship? Say 1 yr to GC + 3 yrs to file for citizenship + 2 yrs to get it. So, 6 more years in the shadows. The z visa would be a lifesaver.

I am waiting since Sept 3rd...when the approval notice was emailed...on Oct 7th today I got the CPO so I guess I have to wait...........USCIS has no pattern so asking for it is meaningless...every case every IO is unique....

Listen a1b2c3, the system is BAD and will need a LOT of fixing. I have been 13 years in this country and provided work for many Americans. I paid taxes like everyone, but could not call NYC home because of a bad system.
I am HAPPY to have my GC because I can also travel oh so more easily, it was a lot of money to spend on visas and all the fees around them (ie travelling abroad every year to go to American Consulates).
One: I have no plans of becoming and American musician or citizen.
Two: I am not JUST criticizing to criticize, the system is "dangerously" flawed, and I just hope my case could inspire others in similar situation. Inspire the elected officials to be "more pushy" with uscis. That is what they ALL did in my case.

Are you guys kidding that this guy waited till 8th month and no insurance.
I think one guy said it right..One needs to be really harsh in this circumstances. When my wife expecting and her company got acquired by the big one..her insurance switched and by mistake we opted for HMO which infact was 20% in patient...and I only came to know at the end of first month after delivery..I must have called 100 time bluecross to cover my wife retro thru my companys insurance..just to amke sure nothing comes out of my pocket..
And here is this statment..that he did not know...
I am not even sure how this person got H1 and h4 and also I140...
I am not IT either..but one doesnot have to be...so many desis come here..make high or low (thats consultant stuff) salaries and do not have insurance...
No wonder we have so many on bench but still lined up for GC..and hence we have such a huge backlogg..thats the hard truth which nobody wants to address..

Don't need to do anything as your spouse is on AOS pending. She can just take a break, but when/if she join in a new job she need to use her EAD.

Even my lawyer screwed my case. Did eb3 instead of eb2. I have got I-140 approved.
Mine too :mad: :mad: :mad: Its simply appalling that so many of lawyers screw up so many cases and still get paid $$$. There must be something we could do about these stupid, money gouging so called lawyers.
