I feel the least USCIS can do to is to accept applications for all the people who completed their medicals prior to their announcement on July 2. Medical expenses are 100% non-refundable and non-adjustable if they have to undergo this again after 1 year. Plus there were so many people including children who underwent x-rays - that's radiation they could have avoided.
If they just accept applications received on Juy 2/3 ..that would just make this mess worse.....
As they have said early July, I think they would go upto 1st week of july which is friday 6th july and would accept some applications received by that date.

Recently there have been a lot of discussions about the order in which USCIS processes the 485 applications and when such a topic is raised by a person whose PD is current and he / she has seen people with later PD get approved, that voice is shutdown saying you care only about yourself etc etc.
Disclosure - my PD is current, i am waiting for my approval, i am frustrated. But what i have to say is not about my case. i am confident that my date will remain current for some time and i will get it approved sooner or later. Who knows what will happen but i don't want to think negative right now :D
What i want to tell everyone whether you are EB2 or EB3 , India or China or wherever you are from - we need to ensure that USCIS follows a fair process while adjudicating cases and that would be based on PD. This does not need a change of law by congress. We should use our contacts and give the feedback to make this happen at USCIS. I think USCIS over the last 2 years has made process improvements but they need to do more. I am one of those guys who has waited 2 years to see my date become current again and saw in 2008 a lot of folks with PD after me get approved. but this is not about me and even we push for this now, it wont help my case because it will take 6 months or so to bring about this change.
think about this - CIR / Recapture happens, everybody will be current, would a guy with EB3 PD 2002 like it if an another EB3 I with PD 2010 gets approved before him - will that be fair? what if 1 year after CIR / Recapture there is a change in a political landscape and they call for some CIR review or whatever and USCIS puts on hold visa numbers got thru recapture. Lets start working on this now so that come 6 or 9 months and we have a CIR bill passed - we will all know that our cases will be adjudicated fairly based on priority.
else i wont be surprised if one yr down the line we come back to the IV forum and we are still discussing PD/ RD /ND and hoping that March 1 cutoff will include MArch 6th and some how we will be lucky.

Can we do anything about it? I doubt it. USCIS is already working really hard (or atleast it seems) to increase efficiency. For the first time in several years we are able to see the data about number of applications pending and calculate how will dates move etc.
Can they make the process of "increasing efficiency" more efficient: again I doubt that would be possible for an agency that collects money by means of "application fees" and spends it for not only the payors of the fees but also large number of other beneficiaries.
On a side note: take infopass and talk to an IO at local office to see anything can be done to expedite your case.

This was long due, I am glad they are now working on it.
It is not a matter to become happy. After AC21 become law in 2000, there is no regulation yet. USCIS HQ has been releasing non-binding internal memos to service centers, which is very liberal. Sofar no one has reported that their 485 was denied due to problem in AC21 job change. As there is no regulation, informing a job change is a volantary.
Further, they told in internal memo that the regulation will be tougher. Once they release regulation one can not interpret the law differently (now you can). Therefore the content of AC21 regulation may not be likable, to most of the job changers.

Considering that USCIS is having the RFE fever now a days, it is best to stick with the employer who filed your GC.
My I-140 was approve long time back that too with a different employer. I think I am gonna join my old employer, with whom I filed for GC.

My husband's EB2 I-140 has been pending at TSC since Nov 2007. His priority date Dec 2003 has been current for a while. He is on 8th year H1B extension. Planning to use EAD after the current H1-B expires in coming june. is he eligible for I-140 premium processing. Anyone with more knowledge on the new rules, it would be of great help if you can please clarify.

I completed my EAD renewal using E-file this morning (The previous one was my wife's EAD renewal, that I completed yesterday night). Turns out the 'FINISH' button is just to generate the receipt in pdf format. The payment occurred before the web confirmation page showed up. So I am ok. Thanks for respoding though. I only clicked once on 'FINISH' during my renewal and the pdf got generated the first time but it still has two pages (identical) with payment information. This is misleading.

Today is the first day of Senate after elections. There are no bills in the Senate or House that refers to immigration, directly or indirectly. That is why there is no thread providing up to the minute information about the developments on the senate/house floor.
We all understand each other's pain for having to wait for long years for green card. At the same time we must say and request to all members to manage our expectations. The elections results have increased the chances for an immigration bill. But the type/form of the immigration bill and whether our provisions would be considered in the base bill is still not decided. That is why it is all that more important for all of us to actively participate in IV. The current situation is more conducive for our provisions but it may take sometime for an immigration bill to mature and pass. As pappu mentioned in another thread, House and Senate Republican leadership had a conference about the issues in the lame duck session last Thursday. Immigration was not mentioned/discussed in that conference meeting. We all want something to happen sooner rather than later. But it is very unlikely that a bill of the size/type of CIR to be considered in the lame duck session, especially when the majority in the Congress has changed.

Thanks for the update Walden_Pond. It is great to see you online a lot of late. I fully understand how busy IV is, and please understand that i was not making any demands. All i was asking was if there was going to be a thread with updates like there normally used to be when CIR was in the Senate.

If you worry about India, go sit outside Google office or UN and tell them to change the map. We care only about America as we have lived here for most important years of our life. We consider America as our home and want to be its citizens. Do not travel with feet in 2 boats. Let people in India worry about maps. We should worry about issues in the country we live and call our home.
