I called NSC IO to my surprise this time it was a nice IO , in few points what she said was
1)They have 200,000 employment based applications pending
2)The processing times says that they are processing cases as of July11 , 2007 but they have cases with RD 2003,2004 so a RD of june 2007 doesn't mean much older case
3)They have 45,000 cases ready to be adjudicated, but not all that cases are assigned to an office. Ready to be adjudicated meaning it cleared the NC and other requirements and has a VISA number available

I am EB2(INDIA) filer with PD of OCT 2006. My wife have H4 until 2010 and we also received our EADs after July 2, I-485 filing. I have not used EAD yet but my wife starts working using EAD and she is on the payroll for about 2 months now. Our EAD expires on DEC 2008 and I sent renewal application 9/12 but have not heard from USCISI NSC yet. Now what will happen to my wife's H4 visa or her status if we did not receive EAD renewal in time? If she quits her job now, can she be still on H4 or exclusively on EAD? Is that scanario will cause any problems in future?
I will really appriciate your help in this matter...

After using EAD, her status is "AOS pending". EAD is not status. It is authorization given to potential immigrants as well as non-immigrants such as Students, AOS Pending people, Refusees.
EAD to H4 happens again when she travels outside and gets I94 based on H4 or applies to USCIS for H4 extension.
FYI, going on EAD might not be reported to USCIS. But she must maintain her records clearly.
If she does not receive EAD, still she is on AOS pending. I9 has provision that if EAD is applied and it is being processed in USCIS, an employee has up to 90 days to give new EAD to employer - so she can continue working, by giving a copy of EAD renewal receipt to employer (in case renewed EAD does not arrive before expiry) attached to I9. Refer to I9 instructions for detail.

Everyone who has NSC-CSC-NSC I-485 application need to contact NSC and make sure that they attach fingerprinting notices to your application. I did the same. With out that your application won't be picked up.
Yesterday, Person in second level customer service center told me that wait for a week and call them again..

I am in the same boat as you, still waitiing for 140 approval. Now, we cant say when the 140 will be approved as the new 485 apps are going to flood uscis. I will give priority to having my H1 renewed in time, along with filing for EAD for me and my wife. My attorney from fragomen agreed with this view.

You are providing for the possibility that it was mailed to your old address before you changed your address through AR-11, and in that case USPS would hold it for you. If its mailed after you change the address, then you would get it at your new address.
I have not yet changed my address with USCIS since I have possession of both apartments for 15 days...the leases overlap....so i think I am going to wait till friday....and change the address with them after that....
In the meantime I am going to ask USPS to hold my mail for 15 days (starting saturday) and physically pick it up later since I am moving to the neighbouring township
though the best option is where I am trying to check with my old apartment management if I can keep the mailbox key for a a few additional days...that would be great and then have mail forwarded at a later date

I know there is already a thread on this topic, but wanted to ask some questions.
Here is my situation: I have a SSN, on H-1B for the past 4 years working all along. Filed for I-485 and got my EAD. From India.
My wife is on H-4 no SSN. We are trying to file for her H-1 B this year. I know its only a 50% chance (may be less).
Now, can I defer my 2007 tax filing to say October? If so, what is the procedure to defer tax filing to either October or later? If she gets her H-1 B approval notice in June can she apply for SSN in say July? Assuming she gets her SSN in July, can we both jointly file for 2007 taxes in say October?
Will my strategy work? Please advice. Thanks in advance for your responses.

I suppose the RN you are talking about is refering to "Receipt Notice(s)"

Thanx for the replies. I have to go to india around august for my marriage. So i thought it might be easier for me to stamp in canada before my previous visa expires. Otherwise, i need to stamp in chennai.
How much early i can stamp my visa 30 or 60 days before the approval in canada. Will i get this info from the US consulate in canada itself while booking for appointment ?

regarding VS 2008, and where to find some of the differences with VS 2005, specially oriented to VB.Net, since it's my main framework.
Have a look at this blog (http://www.danielmoth.com/Blog/) regarding new features included in VS 2008 and also if you do a google search you may end up many results :D
The most important difference one can tell is,
1) Inclusion for support for .NET framework 2.0,3.0,3.5. You could actually create a solution in any of these frameworks when creating a new project :)
2) Integration of Form Controls in WPF. The WPF Editor is good and also good changes in the Add Service Reference (for WCF Services and ASMX Web Services)
3) Good integrated support for LINQ (iow, C# 3.0)

Why does diversity make sense for family based GC's only? Do I sense some arrogance in the implication of that statement, which would be that employment-based immigrants are raceless and bereft of some ethnicity? Do they come from one nation only? I don't think so!
The fact of the matter is that employment-based immigration does affect the demographic landscape of the nation. This is a very funademntal idea that is lost on some people in this forum. True, in EB GC's, you are not given permanent residence as in FB or in diversity-based categories, but everyone comes with a certain race and ethnicity (yes, even skilled professionals!) - that's part of evryone's baggage!
Imposing country quotas on H1-B1 visas is not (definitely not!) a solution, and in fact it would wreak havoc of a must surreal kind. If people are hurting because of the retrogression now, they'll be hurting even more trying to find jobs, if this crazy measure were to be adopted.
As for F-1 visas, no school gives out admission to any program worth its salt merely using the nationality of the applicant as the deciding metric. Just like business, these are merit-based decisions. One gets a job ostensibly because one demonstrates the right skills, the appropriate background and the right aptitude for the job.
A short-term "solution" to retrogression is capture of unusued numbers and transferring them to over-subscribed categories. Also, spouses and family members should not be taking up precious numbers of EB applicants.
Long-term solution: I have a feeling that no durable long-term solution will emerge untill after the dust settles from the elections this fall.

the worst part for H4 is that we cant even do voluntary work............i was a teacher by profession in india.....a kind of professional they need here..................now i dint want to work or earn money but all i wanted to do was do was voluntary work teaching n school in free time but they required SSN so they could do background check before i can be around children now i dont think i will ever volunteer in this country

Also there is Monster,Corp-Corp.com,Dice, Hotjobs,Net-temps. You can look up the recruiter info from the postings and call them to see if they have any openings.

:D .. I was imagining that i would become a religious worker and reapply. As it is i write code and then pray that it works...from now on i will pray and then write code that works...maybe that will make be eligible for religious worker category...working religiously to find the answer. :D
