    Because the alternative is to
    a) sit at home and
    b) bitch about retrogression.

    I am from ROW, and so I am not so severely affected by retrogression. However, I am still fed up of looking at visa bulletins every month, and running into people with stupid freaking smiles on their face, resigned to not doing anything and just bitching about how screwed up the whole thing is.

    There is a way things are done in this country. We owe it to ourselves to try that.

    And if we don't let people who can make a difference know what our problems are, then we should only blame ourselves.

    Like I had said earlier, the purpose of this thread is to come up with the best model possible with the limited data and resources available, that can predict the current dates for PD.

    I am pretty sure that a poster, in the form of a visa bulletin, dated 2020, showing that the priority dates of 2003 are finally current, in an indian grocery store, will get a lot more attention and funding for this forum, than anything else.


    I (and may be lot of others like me) want to care about IV & want to contribute to IV. But there has not even a single thread of good news for last several months. This is very demotivating. I have contributed only once. Every time I visit this site, I feel guilty of taking a free ride. But at the same time I find it hard to make any contributions with nothing happening on the horizon. Currently it looks like what ever is happening or going to happen with CIR etc is just moving at its own pace. If we can not expedite it, then what is the use? in any case congress will pass some relief for skilled workers when CIR comes up.

    I'm not being ignorant, if you are waiting, then there are many from EB non-ROW who have been waiting longer than you. How can you be so arrogant about waiting ? You choose to overlook facts about what EB category is all about. Its definitely not about diversity!

    Would you agree that wives and kids should not be included in the EB GC quota?

    I am EB3 India working for a small company in construction design industry. I have enough experience, qualifications and degree for an EB2. But it is not as simple as you make it sound.
    A major part- 8 out of my 15 year experience in this field has been with this employer and although my employer supports me, they are simply not hiring and have been having a difficult time since 2007. So, they cannot file for an EB2 Labor.

    I cannot change jobs, since my qualifications and experience will put me in a different job-description and title which I cannot because of how AC21 interprets the laws.

    So it is not as white and black as you make it sound. Most EB3 folks started their process way early in their careers and have moved on since. Some of us have been waiting for 10 years and have been in the country for 15 or more years.
    Some started during the last recession in 2001-2002 when EB2 was in scrutiny and dates were current for all, most employers and lawyers were touting the EB3 route.

    Anycase, I do not expect you to understand our situation. So continue speeding on your path of joy.

    same boat here, i bet many others do so.
    back in 2003 when my friend insisted to have my GC file in EB2, my attorney filed in eb3 convicing me saying all are current why bother. ( praying a cleaner route to hell for that attorney ).

    Don't know about his company...but the attorney definitely must be quite rich with all the legal charges :D

    Its all about investing in the employee and has worked so far. ROI to the company is huge if the employee is taken care of (atleast on immigration issues). Employee can just concentrate on getting the job done and making sure the best products come out of the door on time to the end user making the company profitable.

    My take: Money they spend on immigration issues (Law Firm, Renewals) should be peanuts to the profit the company makes.

    Hi, I am working for Company ABC on L1 B, I-94 valid till mid2008.
    I will get married in Feb08 and bring my spouse on L2 visa here.
    She intends to work in the US. I understand that I can get her EAD.
    If her employer processes her GC . Am I eligible to be added on that.
    Basically, if her GC processing starts, is it possible for me to work here irrespective of my visa status.
    Kindly advise on this scenario. We both want to work in the US and I want to switch job provided she is able to continue to work also.

    I had to reluctantly stay away from the rally due to a brand new baby at home, but I sure hope to be part of future efforts.

    And I totally agree that Legal is the keyword. Most Americans are not clear about Legals v Illegals and lump them together. Of course, some just do not care and do not see a need to differentiate between the two. They would just like to see Asian and South Asian folks get out of the country.

    And I also am not in favor of asking for an increase in GC quota. Instead I am in favor of not counting spouse and kids against the quota. This itself will effectively inrease the quota to over 350K per year. Directly asking for quota increase always leaves a bad taste for skeptics and will slow down any possible action.

    All of us (people on L-1, F-1, J-1, H1, B1, K1 and their derivatives....) went to US consulate to request for VISA. US consulate never came to your door with a VISA.

    Everyone goes to Bank and do transactions , that doesn't mean that we only need Bank and Bank doesn't need us and our deposits.

    I am in for this. Is this something that can be a planned effort rather than a impulsive exercise?

    I think we should -
    1) Wait till this session of the Congress gets over.
    2) Form a work group that will chalk out the plan (of efforts).
    3) Execute the planned efforts.

    Efforts could include things like -
    1) Discussing the proposal with supporting Senators like Zoe Lofgren.
    2) Making conscious efforts to publicize our woes and genuine issues / conditions.
    3) Quantify the benefits of our presence - in evidence of a quantified evidence, idiots like Loo Dog, etc. can't refute that much.
    4) Talk to organizations like Lazaras (or some org.) form a more cosmopolitan group including Chinese and others as well.
    5) Letter campaign in mass to all Congressmen's offices telling them the sad story about waiting for 8-10 years.
    6) Any other efforts that CORE comes up with.

    Planned & focused efforts always yield desired results... I believe so.

    It can be planned effort easily if Core team supports us. Otherwise, all of us will be airing our views, but where will the strength come. Even if 50-100 people join hands here, thats not a good #. We need a very big #. Thats possible if a campaign is started by somebody like IV and list it in the headlines section and direct us all to a target.

    Lets wait for 5882, not upset any one.. Once thats done, based on outcome, its Lets shoot for Citizenship.

    Using your analogy, the more Indians, Chinese, Mexicans, Filipinos stand in the checkout, the lesser the chance for ROW people to get through the checkout. So, how can you say the waiting time will be EQUAL for everyone?

    I do not mean equAL waiting time, I mean FIFO. If there are indians/chinese ahead of the line, they are ahead because they got their earlier. So a 2001 Applicant Indian/Chinese is processed before a 2003 ROW. Only Fair.

    Numerous different checkout lines(Quotas) are making it unfair so that a 2001 applicant is left to be adjudicated only because s/he is a chinese/phillipino/indian, whereas somebody with 2003 or later PD is adjudicated before.

    Thats all I mean.
    BTW, I understand that country quotas were designed to probably check growth of any one ethnic group. But I fail to understand how talent and employment based EB;s can be subjected to this, since Talent can come from anywhere.

    She has worked only 1 month in 2009 this will be reflected on 2009 w-2. I have couple of questions:

    Will she be considered as "out of status" from Feb 1 to April end?

    Before I answer your questions, I have couple of them -

    Will she get paid starting Feb 1st? If no, why not. Please explain.
    Will she on unpaid leave?
    Will she still be Full Time Employee?

    I was under the impression that 10 - 15 days gap or 1 month gap can be justified as vacation or sick leave as long as "employer - employee " relations exists (not terminated by the employer). One whole year cannot be justified under this.

    I am not sure what stopped members from local areas(VA/MD) from coming to the rally.

    There were 10 people from Tampa, Florida(about 1000 miles from DC). Tampa is a small city in Florida and there aren't that many tech workers. I am thankful to each one who was able to make it to the Rally.

    I was there in rally with my wife and eight month old baby. It was a vast change of weather for the baby who has been in FL ever since birth.
