:( My case status shows case closed. Is anybody facing the same problem?
Hi abd,
Have your lawyer cotact DOL. My lawyer sent them an email last time and they responded the same day with a screen capture. If they truly say that it is closed, then there is a timeperiod during whcih you can appeal to have it reinstated as long as they closed the case erronously.
Questions:
1) Did you get the 45 day letter?
2) Did you respond to the 45 day letter on time?
If there are no issues surrounding the 45 day letter then I would say the case was closed erronously which has happened to some people.

Actually I filed an AR-11 and also opened a SR on the same day and 10 days later I saw a soft LUD (after 15 or so months of hibernation). So I don't know if the LUD is for SR or AR-11....(although in my AR-11 the change is only the apt number everything else is the same)
Funnily I changed my wife's address too as she is dependent on my application also updated the address for her I485....10 days later I got a letter from USCIS...request denied as beneficiary is not same as applicant...what a stupid reason...why then was there a link to change address for dependents (in the first place).
So I again filed an AR-11 this time as her as applicant and also changed her 485 address.
Though I did an AR-11 and a 485 address change...I saw a soft LUD on my EAD and I-140 (which was already approved at least as things stand now)....
Strange are their ways....

We know that EB2 is getting stuck in EB3 because of PD porting. I request you EB2's not to procrastinate and send the letter in the next post to the USCIS director. You may mail it with or without your contact info and stop this illegal practice.
Pls do not be lazy to mail this letter. It will save atleast 5 years of tension in your life. If you think others will mail for you are sadly mistaken. There were only 3 letters till today. We need 100 letters atleast to be mailed to the director.
Give me green before I am drowned in red ;)

Not all action items are started by IV core and core has so far endorsed only to items. Please read the home page.
It might be advisable to confirm with core before doing somethign en-masse that might backfire. I am talking in general, this might be OK. PLease take actions at your own discretion and please be careful of mis-representing IV.
The real issue to keep our issues with the VB fiasco in the media limelight.
A new item to digg has been added at the top - response from the USCIS director to the flower campaign.

I think TX is worst... I wanted to get the DL for my wife and they asked my pay stub...
That's ridiculous....We went to change my wife's name on her DL and they asked me a letter from my employer saying that I'm currently employed....Had no issues getting a DL for her couple of years ago.

I did E-File for EAD of my wife just now. I clicked on the finish button on the last page, the receipt notice in pdf did not get generated . So I clicked it again . It got generated this time but a page with payment information repeated twice. Now I am worried that I may be charged the fee ($340) twice. Any Ideas or similar experiences ?

Well, don't forget that during the last CIR debate, it was Mr. Obama who introduced his amendment which grossly favored family migration over skill based migration, by awarding extra points for having a relative in US. The amendment was so unjust that we all heaved a sigh of relief when CIR was finally dead.
I would not place too much weight on the boilerplate response of a candidate running for election. ;)

I went through a similar situation and won against my employer without the help of any attorney, can you let me know ur case in detail. I will try to help you.
I started working for my employer last year on H1b. I've also singed employee agreement contract which stated to work for my employer for a period of 1 year (2080 hrs). It also states that in case of improper termination of the contract, the employee is reponsible for the damages caused.
My employer is based in Texas and I am working in california.
After working for my employer for a client about 6 months, I've got an offer from the same client for a permanent position and that I need to transfer my h1 inorder to accept the offer.I transfered my H1.
Since then my employer is trying to scare me with notices through mails. My friends has told me not to accept either mail/phone from my employer. My employer tried to reach me several times through mail/email/phone but couldn't.
Recently one of my room mates accepted a letter from an unknown person (through my employer's advocate) without my knowledge. The mail is a NOT legal notice but a printed document stating the breach of employee agreement handed by a person.
The letter stated the same thing which is present in the employee agreement that in case of improper termination, the employee has to pay for the damages. The damages in the letter include the damages over $10,000 incurred by my employer as a result of the termination of contract.
It has also stated in case I do not pay for the damamges, my employer has no choice but to persue with the arbitration method of resolving this issue.
The same thing I shared with few of my friends and I had mixed responses. One was insisting to pay for the damages in order for a smooth transition. The other has told me to post in this forum to get valuable advice from the members.
Another friend has told me not to bother as my employer also breached the general labour acts such as not paying for me while on bench, taking fees for the filing of h1,not paying for the medical insurance (as stated in the employment agreement).
Now I received a similar document delivered in person to my office desk.

when you apply for H1 ext beyond 6yrs you should send them proof like I-140 approval copy. Did you do that?
Labor got approved last year around November from NSC and 140 is also approved couple months back from NSC

I do not think the existance of the company who filed your GC matters after you have used the AC 21 portability to a new company. Do you have any basis for your worries?
