    Yes you are right and i am working for a legit company and do get paid fairly.
    However karma can nail anybody down.

    I do have to pay for Premium, if i don't get my I-140 cleared by then and then H1-B extension. I am lucky that my company is bearing 50% cost for GC and 100% for H1-B related costs. I am also going through one of the best law firms in boston and so far they did an exceptional job and hope to be the same hereafter.

    I also hope that by next may/june we will have some good news on SKIL bill.

    i got my i-140 approved in 6 days (way before premium processing was implemented- guess i got lucky)..this was in the first week of feb.

    with an eb2 priority date of sep 2005, thought my turn would come by now. I missed filing the concurrent 140/485 that went into effect on Oct 2005.

    i had to vent this morning. this whole process is ridiculous. Even the older retrogression did not last as long as this.

    I'll try to experiment with this as well.. not sure what could be causing that.

    for people who are having problems with the swift3D file sizes in general.. try producing stuff as just edges.. leave those fills out. At least to see. You may not like line drawn stuff, but it's size is a hell of a lot smaller than with the fills.

    yes. You can keep changing jobs as many times as you want, invoking AC21. Keep sending USCIS a new G28 and Employment Verification Letter whenever you jump.

    To apply AC21 what lawer needs to do? Just file G28? or ther any other documents required from original employer?

    G28 is Notice of Entry of Appearance as Representative. You only need a new G28 if you are changing lawyers.

    What is Cross Chargeability?

    When a Green Card applicant is subject to a quota waiting list, but is the child or the spouse of persons born in a country with more favorable quota, the applicant may cross charge to the most favorable quota.


    My child is born in USA, can I cross charge to USA?.......What is US Priority date?::):):):)

    Based on the definition you posted, the applicant should be the child! Immigration status of applicant's child doesn't count!

    You can start a company on your own. It just cost $350-$500. Contact any lawyer company and ask for details to start company. But if you are the share owner of the company you can not do your GC.

    There is a risk working for small company and doing GC. USCIS normally asks for companies ability to pay the employee. If company fails to prove ability to pay, then your GC will be rejected. It happened with my friend. His company had 20-30 employee but the company always showed loss.

    You can invest $1/2 million, employ 4 or 5 US citizen and process your E visa!!

    1) If a company with few people in it , but they paid what is mentioned in my labor consistently but has meager profit margin .

    2)The company need to have history with all assets .

    If there is LUD and the status of case changes is called hard LUD, if there's an LUD and everything remains same except the LUD then its an soft LUD. Hope that helps

    If you e-file EAD renewal ---> you get the finger print appointment.
    If you send paper based EAD application ---> you don't get finger print appt.

    You are right . I renewed it recently by doing paper filing. i didn't get any FP notice. I don't know why is that?? If you have ideas, please let us know..

    1. Section245(k) of INA pardons "out of status or worked without authorization for less than 180 days"
    2. The out of status days are counted only from "last lawful admittance".

    Hey Guys:
    I do not have detail about my RFE. But, I understand my wife & I got an RFE on our 485 applications. I have a concern, I was on F1 visa until 12/31/2003 and moved on to H1B visa on 01/20/2004 (without applying for OPT); so for those 20 days, I am guessing I was so called out of status. Am I correct? Can this cause a problem? I applied for H1B around 10/2003 based a full time job.

    Here's the rule for your reference.

    Guys do not geopradize your Job Privilage through H1 or your "GC Dream".
    Think twice before you "endorse" your support and throw dirt on politicians in this country. Avoid trouble where ever possible to stay clean.

    Again I would urge the Admins to close this and delete the thread. a "Vote" for us in the community is a far away dream may be after 4 more prez election in US (10 years in GC and 5 years for citizenship). Who knows whats in hold for us in future?

    If you are afraid of withholding of pay then leave quietly from the company saying going to India etc excuse so that your payroll gets processed. I have seen people doing that effectively.

    Legally they should not withhold pay and if they do, then you can complain to DOL.
    DOL is awfully slow sometimes in getting the enforcement done.

    my I 140 was denied on april 18th but i didnt get denail notice till 13 of may .I had only 4 days to file MRT .Was denied on A2P reason .I believe my attorny overlooked the thingds .He sent sone old W2s from old employer whn my pay was one fourth of my pay in LS .MTR fild may 18th ,reciened may 29th and I 140 approved july 15th and 485 reopened same day .Onle update sad 485 reopned and we'll make decision in 30 days but almost 45 days have passed no update .My wifes application is with mine and she never got her FP fone and her 485 says same thing .
    do u know how to contact these political people ?

    In 2004 I retained the services of an International Tax Accountant to file my tax returns and per his advice, immigration attorney fees are not a tax deductible item. However, paying an accountant to prepare your returns are tax deductibe the following year.

    Let me also add, that in the US we are expected to pay taxes on our world wide income. There is of course a dollar for dollar tax credit and then we must pay taxes on the portion that is underpaid compared to US tax rates or pay taxes on items which are not taxable in your home country but considered taxed under US law. See, this is why I retained the services of an International Tax Accountant.

    I have read that some airlines agree for travel uptill 36 weeks of pregnancy for their travellers and enquired to confirm that. I am planning to visit India in July 2009 (I'll be 21weeks) and come back in September 2009 which would be around 30 weeks, I'll be on bench and would like to spend some time with family.

    My question, would that pose any kind of problems at the port of entry from immigration perspective. I'm on EAD and will be using my AP for travel. My husband is planning to stay back in US, I would be alone while travelling....

    Please advise if anyone travelled around that time in their pregnacy to India. Moreover our priority date is Oct 2004 EB2 and Notice Date is Oct 15th 2007, we are expecting some kind of movement this year. Would any RFE's or approval be an issue while I am visiting?
    We did that last summer on AP. There was absolutly no issues. We got a letter from our OB/GYN stating that he has done a exam and it is safe to do air travel upto certain date. But his suggestion was don't show this letter to airlines unless they ask for it. Or else they may start thinking there is something wrong. We took singapore airlines and actually after the flight took off my wife told the flight attedent that she is pregnant and asked if she could use the 3 seats in a row that was empty. They agreed to that she was allowed to even lie down and rest from SFO to singapore.

    At POE they have nothing to differenciate whether you are pregnant or not should not make any differnce permitting you in.

    Mine had a RD of May 1 too at NSC. I checked the status for the first two weeks and it said it would be approved in 150-180 days. Now it just says that it is being processed, without any mention of the days it might take.
    I also had the same experience, first few weeks it was showing the time line not it doesnt. Does anybody know what could be the reason for this?
