We had a very productive meeting on March 8th. It was well attended, and represented people from South Asia, South America and Europe.
We also got an update from the core.
Over the next few days, we plan to meet our lawmakers, and inform their of our situation. It is absolutely imperative that we do that soon.
If you are from Wisconsin, we need your help. We need people who live in the different congressional districts of Wisconsin, so they can get appointments from their lawmakers.

d) not wimps, conspiracy theoriest, or believers in the my-congressman-will-eat-me-alive theory

Colorado is hardly a border state by any means, nor is it faced with a flood of illegals. How can a guy with one single point of argument keep getting re-elected to office? I suppose they voted based on party lines and not on the stance on issues. Either that or Littleton, CO has to be the most backward community in the US.

At the port of entry, you have the burden to prove that you will comply with the terms and conditions of your L-1. The short period of time remaining before expiration of your visa could reasonably trigger an inquiry into your plans to depart from the US prior to expiration of your L-1 status on June 15. These days, simply asserting that your employer will be filing to extend your status may not be enough to meet your burden of proof.
It would be far safer for your employer to file for the extension before you leave the US and then send you the rec't notice to carry with you when you return to the US.

I will be travelling abroad and return with 10 days left on Visa Validity (But having an Approved 797 with 3 year extension validity).
Will I get I-94 per 797 Validity or per Visa Validity? If it is per Visa Validity, how to get the I-94 extended
What about the H4 ? My dependent's H4s are also extended. Will they also get I-94 per new Approval ?

Don't worry.
My friend filed on June 10 and travelled to india on 12th June. He apperared in US consulate in mid June and got 3 year visa extn. He was back on country on July 7th. He completed his FP on July 13rd. I was looking his mailbox in his absense and informed him for FP notice. So please make similar arrangement.

My 485 petition reached USCIS on July 18th and I am travelling to India on August 17th, I have my h1b visa stamping at Chennai on August 21st. My employer and his attorney strongly recommend not to travel until we get the reciept notice.
Murthy's FAQ is confusing, does not say one must not travel, but says it will be better if one can avoid travel.
Is anyone else in the same boat? My travel is essential. It is my brother's marriage and I have to be there.
Any takes on this? Has anyone called USCIS?

I did not know about cross chargeability! It might work very well in my case..
I am from India and I have my i-140 approved and waiting for my PD(Oct07) to become current to file for my I-485 under EB2.
My girlfriend who is from Portugal, is on a F1 visa.
So if we were to get married - I can change my 'chargeability' to Portugal instead?
Isnt the chargeability solely dependant on the nationality of the primary applicant?

Hello all,
This is my wife's situation: We applied for 485 in July, got the EAD approved today. Her 180 days end on Jan 17th, after which she plans to use AC21 (with either H1 Transfer or EAD). Her current H1B will be expiring in March 08 ( she is already in her 6th year). So here are my questions:
1) Can she keep extending her H1B after invoking AC21 with H1B transfer based on the fact that her I485 is still under processing?
no. the basis has to be either an LC that was filed >365 days ago, or an I-140 thats approved. 485 filing alone does not allow you to get H1 extended AFAIK.
2) If she wants to go for studies (part-time or full-time), does EAD has any benefits? Can she apply for federal tuition assistance because of having EAD? If she uses EAD for studies, does that negate her H1B even though she is not working?
Her H1B status will end if she stops working (irrespective of whether she studies or becomes a homemaker). EAD does not matter for tuition assistance or fees point of view. depending on how long you have lived where you are living you might qualify for in-state tuition etc. there was a thread on this topic (college fees after filing 485 or something like that a couple of days ago, try digging that up for info, I am not able to find it right now)

Hi, my husband and I had our interview today at 2pm located in San Jose. Everybody was called for their interview except us and we were wondering why we had to wait for an hour and 25 minutes. Only then we found out, the immigration officer who picked up our appointment letter forgot about us. :mad: When we finally got in touch with someone, we got called in at 3:25 by an old lady immigration officer. She was cold, unfriendly, had a very serious face, and did not make eye contact at all. She did not make things easy for us and there was tension everywhere.
My husband and I have been together for almost 7 years now, but we've only been married for 5 months. I am the petitioner and my husband is the beneficiary. We don't live together because of school and work complications. But we do have evidence to show our marriage is bona fide. Starting with airline itineraries visiting each other going back from 2004 to present, joint checkings/savings account, joint auto insurance, joint credit cards, joint phone account, email love letters and online chat messages from 2003 to present, receipts from motels where we stayed whenever we visited each other, and receipts from places where we ate together. Also, we turned in my tax returns, 2005, 2006, and 2007 and since I have already filed for my 2008, I have included that as part of the supporting documents. We also turned in my pay stubs for the month of February and March, along with an employment verification letter from my employer. Even though we have turned all of these documents to support our marriage is real, the immigration officer gave us the face as if we're going to get denied anyway. Then as she was going through the supporting documents we submitted with the application I-485, she noticed the seal on my husband's court disposition letter was missing. They lost the seal and told us we have to go back to court and get another one because she was thinking we tampered with it. Oh my god, in my mind, I wanted to lecture her to tell their clerks to be careful when filing important documents. They lost the seal to the court disposition letter! :mad: Then she saw her colleague and asked for his opinion and said to him, 'we have a problem'. He started asking us questions like how we met, how old we were, why we're not living together. After we answered, he said 'thats a tough one' and then he left the room. Then, our immigration officer stood up and said she's late for her doctor's appointment. My husband and I were so confused and shocked by all this. It was as if she didn't give a crap about us just because we don't live together even though we have tons of evidence to back up our marriage. It was the worst feeling in the world and felt like our life was taken out of us. :(
So now, we were given a piece of paper stating we have to turn in another one of my husband's court disposition letter with the seal included. It was their fault in the first place for losing it. Not only did our immigration officer made us wait for an 1 and 25 minutes, but she forgot about our appointment too. She never even apologized. She was not a nice old lady. Then she told us our interview has to be reviewed by her supervisor, and from the way she treated us after finding out we don't live together, she gave us the look that we have no chance of getting approved. :( On the way home, my husband and I were quiet the whole time, still shocked. Sorry to know about your bad interview experience. If they call you again for an interview, I would advise to take your attorney along with you. You will be amazed to see how the interviewers' behavior or attitude changes when she/he sees a attorney supporting you...Hire a good attorney just for this purpose if need be, but do take one with you..Wish you the best..
