When we Use AC21 and Join a New Employer after your I-140 is Approved.
USCIS will NOT Look at the "Ability To Pay" of the future employer.
This has been Clearly specified in the AC21 Memos.

Dude, Dont argue for the sake of argument. Please go and read 245(k) first.

I-94 vlaid till 02/15/2010
Do I need to apply for a new AP before 04/30/2010 even there is no plan to travel abroad (just to maintain status)?
My understanding is with I-485 Pending status I can live here legally. Valid AP is required only at the time of trvelling abroad. AP need not be maintained continuously.
Can someone please clarify?

Guys, there are 245 countries worldwide and many choices to choose from the other 244. Many people will just as easily move to Canada others will fit where it suits them best which could be home. Often Australia, Canada, New Zealand, Germany are mentioned as countries which take in high skilled professionals. Sometimes forgotten are countries such as Ireland which is having an IT boom or the Middle East eg. Quatar, Saudia Arabia, UAE etc where the benefits include perks such as a tax free salary comparable or better than a US salary, two round trip tickets per year for the employee and their family to the employee's home country, entertainment, house and vehicle allowance, in short your greatest expense in some of these countries is basic sustenance needs. Lesser known but unmentioned countries having an IT boom are in Africa and many new frontiers where outsourcing is taking root. This bill will only help accelerate and encourage the growth of industry in these countries. It is now inevitable thanks to the misguided bill. I also filed G28 and AC21 with my attorney 2 weeks back and there is no update/LUD. I called USCIS yesterday to know if they have updated information for my attorney. First time they replied they personal details they only can provide at local offices and not on phone.
They also mentioned that G28 does not have any return receipts, it needs to be sent through registered post/courier. Although, my attorney mentioned to me that we will receive a confirmation for ac21 which normally takes weeks!!!

My lawyer asked me to mail again with a cover letter saying that since my checks were not cashed even after 60 days I am mailing again. I asked the clerk to ignore the new application if they see my original application by the time they open this.

I heard that rumor. Not sure if it is rumor or really happened. I was told that this incident happened somewhere in Virginia. Also, one of my friends was grilled at POE in SanFrancisco before letting him in.
But the IO at POE has the authority to deny entry. On what basis, I am not sure..
If anyone or direct friends of yours faced this experiance..please post here for benefit of everyone..
There is a big rumor going around about sending back the people with valid visas at the port of entry. Can the IO just send the people saying,there aren't enough jobs? I definitely think it is not that simple. But would like to know what are the guide lines given to them. Like what could be the standards that should be met. How this is different for the people entering with H1b status and using AP. What are the options if somebody is denied the entry but is genuine. Please through your opinions as someone could be more prepared while they travel.

The EB1 has a section for international executives and managers. Does a manager need to necessarily have direct reports ? For example a project manager managing a large project on-site might not have direct reports but might be managing a $10MM project. I have a friend who has the offer to come here on L1 as a project Manager. He is wondering if he can take advantage of EB1 as a multinational manager. He is coming in on managerial capacity.
Does anyone have any information on that ?

I m not sure you get 1 year or 3 years , but just apply your H1 extension with approved 140 and forget about pending 140
