I think, answers are mixed and they cover two different topics Visa Revalidation and Autimatic Visa Revalidation.
Thanks Venram, I'll carry "Employment Verification Letter" also as per your recommendations.

I ran into this issue and was appalled to hear this. I'll PM you for the Agents#.
Thanks for the person who started this thread.
I am on H1, I just got some life insurance through Metlife, i don't think Metlife is underrated in any ways. If you need help, I can give you the number of my agent. And no premium just because we are on h1-b.
If other insurance agencies dont want your business, screw them, just take your business to those who appreciate.
Send me a PM for the my agent's number.
Regards,
dgb

Did you have an approved I-140 or an I-140 application under USCIS consideration, when your wife applied for F1? Thanks.
No my wife never submitted anything related to GC. University approved papers only included copy of my latest I-797's (I am on 3 year extension after PERM labor/I-140 approval). I remember the papers submitted to university (for review) included all that but they sent the approved I-140, etc, back to her.

How about we send congratulation letter to President-Elect Obama. This should go as a combined effort from the whole IV community. Any thoughts???
Dear President-Elect Obama,
Legal Immigrant Community in USA would like to congratulate you on your impressive campaign and win. We wish you all the best for your presidency tenure and promise to provide you our support and in many manner we can.
We would also like to take this opportunity to bring your attention to some common problems which legal immigrants are currently facing.
1. Average wait period for greencard wait is 5-15 years for both Employment based and Family based categories.
2. Extreme dependency on employer because of unclear 'Same or similar job change regulations'. We cannot accept promotions, salary increases or any job title or location changes in order to not lose the status on current pending Greendcard application.
3. In this current economy, many legal immigrants are losing their jobs resulting in changing employers for which they have to go to the end of the line again and start the GC process all over again if the job title or salary is much differnet from the original one.
We understand that USA is currently facing more pressing issues at this time which need your imminent attention but few simple reliefs from your administration will make the lives of immigrants much better here. As a result, they will contribute more towards the economy, buy houses, make long term investments and establish new businesses. As a result, more jobs will remain in US which will have a posiitve impact on the consumer spending.
Suggestions for relief to immigrant community:
1. Capture wasted Green card numbers from the past due to bureacracy delays (such as pending HR5882 bill).
2. Remove Same or Similar job requirements for Green card applicants waiting for more than 1 year in their I-485( Last stage of GreenCard). They should be allowed to join any employer with any title or salary changes.
3. Allow pending I-485 applicants to join schools full time without affecting their Greencard applications.
4. Allow pending I-485 applicants waiting for more than 1 year on their last stage of greencard to establish full time businesses without losing their H1-B or pending greencard status.
5. Allow temp visas for family members who are stuck in lines for Family based immigration.
Few simple changes as stated above will bring imminent relief to legal immigrant community. Many of us want to buy homes, start businesses, go to school full time but cannot do so till we become permanent residents. Wait periods are so long that we are stuck with the same employers with stalled career growth.
We expect that you will consider the above ideas and bring the change that all the people are hoping from years who are stuck in legal limbo.
Thank you

More times than not common sense goes missing among the highly educated. The trouble is, you mix that fact with added politics, and now you have a complete and utter mess. They are dumping money in businesses without making sure of returns. This economy is not going anywhere.... they can fool trusting citizens, but not people with common sense.

Suppose i get the H1 extended for 3 yrs as well as transferred to Company B first ( based on 140 that is approved by Company A ) and i'm also working with Company A now - no issues. Now after the the extension papers reach my hand - I leave Company A by writing a nice and gracious letter and 15 day industry standard notice period.
Even after all the fomalities if Company A gets angry now because they lost the cashcow and to teach me a lesson 'revokes my 140' - WILL my 3 yr H1 extension (which is already approved based on that very 140) be also revoked and USCIS will reopen my case proactively ??
By the way - i'm not worried about impact on 485 - i know that remains protected by AC21 after 180 days - but i MUST NEED the parallel H1 to keep my wife in status in H4 until my PD gets current and she can file AOS.
From what i understand or interpret AC21 for H1 extensions beyond 6th year is you should have 140 approved/pending.
Once I-140 is cancelled by employer we can NO more extend H1 beyond 6th year and it automatically cancells the H1 approvals after 6th year since it was approved based on I-140.
I MAY BE WRONG - If i were you i would consult an immigration attorney for professional advise.
Thanks,

Govt Fee for H1 -> AROUND $200
H4 -> Around $140
Lawyers can stretch you to any extend , my idiot lawyer billed me $750(h1)+$500(h4) for copy-paste from 7th year extension to 8th year extension, that is the reason all immigrant lawyers like BEC.
I have some question regarding the H1b Extension, is it in every extension the company still have to pay $1500 (before is $1000) with company check which used toward scholarship for us citizen ?

Hi,
Long time reader of the forum, first post. My mother is very ill and she is in India and I need to go to India soon. Here is the situation, My wife is on H1b and I am on H4. We have not left the country so we don't have visa stamps in our passports. We both have the I-797 approval notices. Mine was f1 to h4 after we got married.
Now can I go to Canada and get my H4 stamping done instead of India, I feel there is a better chance in Canada than India. Does my wife (principal applicant) needs to have her H1 stamped on her passport. If I need to do it in India, what documents do I need, do I have to go the consulate or I can come to USA and at the Port of entry they will stamp.
Please advise
If your wife * H1b ) holder has job or project and client letter and not on bench in last sixth month and have W2s for past years then go for India that will save cost and time. You may qualify for emergency appointment in India. Appointment in india doesn't take more than 2 weeks these days.

bharatpremi+others,
this is great poem, one we often went back to when i was growing up.
however, i don't know about others, but i'm am bit tired of the same repeated 'join your state chapter or you are doomed messages'. whenever someone new to the forum posts something, there are always some people immediately asking the question, 'have you contributed', 'have you joined your state chapter'...with negative energy. this is a very violent approach in my opinion. the newcomers first need to convinced before we start ramming them.
in case some of the readers are ready to start slamming my post - remember, i'm an active and contributing member, and have also helped a lot of people sign up.
the approach i'm now following is the following - reaching out to my immediate friends and asking them to start contributing. when a message comes from someone you know, it is much more potent. For more information I'll refer you to Cialdini's book, 'Influence' (prescribed in most top mba schools). The concepts I refer to here are called Social Proof and Liking.
Social Proof - People will do things that they see other people are doing.
Liking - People are easily persuaded by other people that they like.
I'm often suprised when I talk to my friends that most people do not still understand the gravity of the situation. They are waiting for their 180 days to be over so that they can get other jobs. In some sense, the Jul 2nd fiasco was a bad thing.. it provided short term relief and has left people with hope that everything will be over after 180 days.
In any case, reaching out to friends, convincing them and in turn asking them to reach out to others is my way to go. and it is working.

same question...hope to see an answer
when does the actual 180 day clock start?
Eg: If the 485 application was sent on July 17 - received on July 18 at Nebraska.
Does that mean on Jan 15 2008 (181 days) - one can switch jobs using portablity?
Thanks!

My wife did a successful transfer from H4-F1 in her last semester and is now preparing to apply for her OPT. The university designated officials reviewed all her paperwork.
We submitted bank statements as a financial proof as a proof to cover first year expenses. The F1 was approved in 6 weeks.

I never used my H1-B, I worked for another company using EAD, that voids my H1-B status so I used AP to return.
What do you mean it is not lawful entry ??
For I-485 under employment based category, applicant can avail 245(k). Under this section applicant can adjust status to Permanent Resident as long as out of status since last lawful entry does not exceed 180 calendar days.
For this purpose only, the last entry counts that was made on non-immigrant visa. What was your previous entry with visa? That will be your last lawful entry for I-485 purposes.
Using AP is valid entry, however, it puts the applicant is parolee status.
I suggest that you follow up with your attorney.

I have decided to change my job after being a full time employee at the same company for 5 1/2 year. I am a electrical engineer by profession and have two masters degree from US in EE and Biomedical Engineering and Bachelors from India.
I have an offer from a consulting company whose direct client is Microsoft. They want a vendor engineer on a 1 1/2 year contract which, according to the company, have good chances of being renewed. The pay is much better than what I am earning now. They are willing to do initiate the green card process as soon as I come on board.
My questions are
1) When should I give the two week notice ? The company is insisting me to start as soon as they send the H1b application while I am insisting I will give the two week notice to my employer after they send out the application. I tried telling them that I will join after they get the actual approval but they are not willing to wait that long. Do you think if its worth the risk ?
2) This is not an IT job. The company has around 30-35 employees most of which work as contractors for MS. They have only sponsored one H1B till now. Do you think their inexperience can be a risk ? They are using a lawyer to do the H1b filing.
3)My priority date is Nov 1st 2007 and I have an approved I140. At this stage would you take the risk of changing jobs and going on a 1 1/2 year contract .......or stick to your current job for another 1-2 year till your PD becomes current.
4)My wife will be going to India this summer and will need to get H1 stamping. Do you think she will have problems getting visa since I am changing jobs and will have only 2-3 paychecks with the new company by then. Also since this is a contracting job is there a risk in getting H4 stamping ?
5) I am not sure if the new employer is apply for premium processing. If they don't how long does it take to get H1B approval from the date of application.
Thanks a lot guys.
Request them to apply for premium H1 processing this will give you better options. Normal H1 processing these days is taking up to 5 months. Given the economic situation and H1 approval scenario I would not switch jobs util my H1 is approved no matter how big the salary difference is. By switching jobs with out H1 approval will jeopardies your status, meaning if something goes wrong you will be forced to leave the country.
It is very risky for your wife to travel while your H1 transfer is in progress. Contact a good immigration attorney to get advise on your situation. Your situation is worth spending couple hundred dollars towards these attorneys. Since you have Masters from US dont forget to ask your future employer to file your GC in EB2 and since your I-140 is already approved you can retain your PD. Wish you good luck.

... the villified latino voter however how much demoralized really does not have anywhere else to turn to and can be strung along to keep current congressional structure in hopes of getting reform in 2011....
I know its a long shot and pure speculation but hell that's "politics".....
I agree with Saket. There will be some saber rattling, some lip service, some false starts, some failures that can be conveniently blamed on republicans to make them look bad. But no real decisive action on Immigration this year. Sadly, the latino votes will be used again...and again. That is politics. No one really wants to do any real change. They want to do their time then move on. Some decisions and laws have to be passed just to ensure that they return to power again.
- Totally pissed but refuse to give up hope.
