I actually made someone in my family do this when they changed houses as they had no idea about this (GC holder for 15 years). that person was so mad with all the rules WRT transit visas (travels extensively) that they decided to get their citizenship finally. :-))

Thanks for the reply. It looks like the second RFE was based on the response to the first RFE. My RFEs were straight forward. So I am hoping that there are no more RFEs but USCIS no one ever knows.

I heard that USCIS will request NVC to transfer the file to USCIS.
I thought that it may delay the process if it goes to the consulate office, abroad. That was the reason why I wrote a leter to NVC, just to keep the case at NVC instead of moving it to Consulate, abroad.
I talked to NVC few times. Some representatives said that they need a written letter from me, so that they can retain the case at NVC, but some representatives said that they need the request from USCIS to stop the CP to move to consulate, abroad. I am not sure which one is correct.
I am waiting for the automatic response system to get updated with my request. I will see whether NVC considers my written request or avoids and process the case send to consulate, abroad.
Any ideas or suggestions?

Two problems:
1. You may not qualify for EB2. One scenario - three year degree like Indian BSc. Even if you have more than 5 years of experience, Service centers do not approve I-140 in EB2 with three year degree.
2. Money and time
However is you I-140 is cleared why can you not take up the promotion and refile under Eb2 again keeping the old priority date.

Hello,
Here is a situation. Me and my wife have been permanent residents for the last 5 years and apply for citizenship. I was the primary applicant when our Green Cards were processed.
Our daughter who is born in the US is citizen by birth. My wife applies for Naturalized citizenship and I do not. Once she gets her citizenship and decide to go back to my home country (entire family). Here are couple of questions that I would like to ask:
1. What will be my status after I go back to my home country.
2. What will be the status of my wife?
3. Let us say I lose the permanent residency status, can I in the future become a naturalized citizen based upon my wife's status.
Please advise.

Why you(r) BIL wants to maintain his Indian citizenship?
If he is looking to buy property etc he can use the Overseas person of Indian origin card
If he is looking to contest elections or vote he might not be able to right now , may be in future he can.
Its quite obvious that he will lose your PR status if he does not maintain residency here at the same time the option you discussed can be possible but who knows how many years it will be before he gets the status back.

this is a great idea, i have thought about this many times, but didn't post anything because there are many in the IV forums who think that IV should remain focussed on immigration issues. many fanatics will even complain about people worrying about their receipt notices or other things.
starting a linked-in group is a good idea, even a free job board is not too far-fectched.
a very simple start could also be a mailing list that people can sign-up for where people can post jobs. this could serve as a great channel for IV to ride on whenever it needs to post an important announcement.

I really doubt anything will happen in immigration whether legal or illegal for 2 years. History shows immigration policy was restrictive when unemployment is high. It is not for discouraging any attempts but real situation now. Even business is not that much aggressive. During Lame Duck Session I saw IV was only one lobbying to attach Visa Recapture.
But as usual CIR may be introduced including Eb reform in Feb. Lawyers site will get attention by their big analysis. IV Forum members will discuss again who is left out in the bill. Finally it will sit on Judiciary commitee and expire in December.
But there is a belief that EB reform has strong support in congress. But if that is the case why any piecemeal bill is not coming out of Judiciary commitee for the past few years? Only reason told was everything waiting for CIR. The setback of Dream Bill shows that even Piecemeal Bill is also very difficult. Probably Still IV might have expressed optimistic view in Donor Forum about 2011. But for 2011 and 2012 " Hope for best and Prepare for worst'

I told my lawyer to apply. He applied through postal mail. My mind has just stopped working and i am getting all worked up due to this unecessary stress.....Jerrome what FAX procedure are you advising?
You can work w/o EAD as long as you have receipt notice. Inform your employer and provide receipt.
Let's put an end to this discussion as i have been working the same way and work for one of the top 3 banks here. I verified this not only with USCIS but also with the legal dept. of the Bank, they did get back to me saying it was ok to work with EAD receipt.
Please don't complicate straightforward laws into red tapism..
Stop whining and enjoy life..GC/EAD does not get you into heaven with 72 virgins...:D:D

Hopefully, recapture of unused visas, increase of GC quota for EB category, maybe STEM US masters GC exemption, removal of country limit, removal of GC Lottery and using that for the EB categories etc etc etc.

I had an RFE for my I-140. Applied under EB2 (5 yrs of exp. and Bachelors). RFE is reg. my 5 yrs of exp. They asked me to explain my job duties, title and the exact dates which i worked for one of my prev. company. Submitted it in about 3 weeks........and RFE is cleared.

I'm not sure if your situation is the same as OP's. In his case, he had a valid H-1B with company A. He applied for a transfer to B. Before he even got the approval he worked for B. Then his transfer was denied. So technically the only H-1B, and hence LCA, valid till now is for A. Wouldn't his work at B be considered unauthorized?
As others have suggested, you can always go back to your previous employer. I have been in similar situation as to go back to the previous employer, after working with the transferred H1B for 3 months. My new employer was even worse than the previous one and I decided to return to my previous employer. I worked for them for 2 more years and then did a smooth H1 transfer to a 3rd company and working for them since.

Hi Friends,
I am planning to use AC21 & join full time on EAD. I have couple of Qs in case I get EVL RFE. I was looking at today & noticed that people recently got some lengthy RFEs.
1. Does EVL need to say exact duties as per labor or could it be actual duties (which would be same/similar)? I am not sure if all employers would be comfortable in copy/pasting from Labor.
2. The letter must also indicate whether the terms and conditions of your employment-based visa petition or labor certification continue to exist.
Question-->What does letter need to say to cover this requirement. If new employer is not aware of AC21/Labor/I-140 and hires on EAD, he may not be willing to write Labor/I-140 in EVL.
All ideas & advice welcome.

There's one called Palm Grove that I've usually stayed in. It is quite close to the consulate, i am not sure if it is walking distance, but auto rickshaws take the minimum charge and it hardly takes 5 minutes from the hotel to the consulate.

It is called soft LUD, which happens most of times, when there is no real change in the wording inside that link but still you can see a new date. It may happen sometimes when they reindex or restructure or something in their file/database system. An LUD does not always carry description change in your case/file. I hope this helps.

How do I see what was changed, as when I click on that line it takes me to the page where it describes when my application was received in August'2007 etc etc... doesn't mention anything about changes done on 01/04/2008 .

FYI...
Checked my bank account and the AOS, biometrics and EAD checks have cleared. Filed on June 30th and received at USCIS on July 2nd. The receipt numbers are on the back of the check.

you can not go back to F1 once you file 485. You clearly have an intent to immigrate, so you wont qualify for F1.
